Help Please - PCN number plate not readable?

Hi
i am hoping you can help, I have spent hours searching the forum but am really not sure what to do here.
I stayed at a hotel for the weekend with my wife on my motorcycle, and have received 2 PCN's from the parking company that runs the carpark. They are members of IPC and run cameras to control the car park. We registered the numberplate for the motorcycle on there database for our stay.

I have received one PCN for 'parking on the pavement' and another for I assume not leaving on time the day we checked out, it says' Not registered on database for area'- I now know the small print says 10.15am on the day of departure , but I did not see this, and by the time we loaded up and waited for the receptionist it was around 10.55 by the time we left as she was not at the desk.

Now, I have always left my motorcycle near the reception as it is simply a safer place to leave it - generally someone around and CCTV etc. Unfortunately a lot of people I know have had their bikes stolen recently, but I probably should not of done this.

The number plate on the motorcycle is not clear at all on either of the PCN's - Should I pay them or argue it?

£100 per PCN or reduced to £60 if I pay it this week - I should of stayed in a better hotel!

    this is the best way to beat an IPC scam claim .......

    as per the motorbike ..... only having one reg plate can play havoc with ANPR systems that are far from good any way ......

    Argue it. Make them prove everything, including that they have jurisdiction to issue invoices outside of the car park.

    Was this ANPR (recording plates in/out) or CCTV?

    Write bad stuff on TripAdvisor, they hate that.
    You never know how far you can go until you go too far.

    It did't have ANPR - Just CCTV controlled. I haven't complained to the hotel yet.............. I am about to read all the info on IPC scams!

    I am getting tempted to just bin them to be honest, unless you say thats a really bad idea?
    You can't read the numberplate properly on any of the pictures. And I have just clocked the last picture for the morning we were leaving the panniers are on the bike and its zoomed right it - I am probably actually on the bike leaving!!!!

    It'll have recorded you entering and leaving. Not parking.

    You should be able to get the hotel to cancel the invoice from their agents.

    YES, complain to the hotel and request they cancel it .... that's if they want your custom in future.

    And, Trip Advisor as said earlier ... you need to warn the public about this hotel and the cowboys they allow

    When a comment is made through trip adviser, the hotel is notified, they will know

    if they have captured his picture parked where he should not have parked , then it was not ANPR on the entry/exit, the chances are that the hotel (or a member of staff) is on a "back hander" everytine they send a photo taken on their brownie box camera


    who is the PPC , worth checking on there website to see if they off "self ticketing"


    the easiest way out of this is to email the hotel MANAGER and state your horror on receiving tickets THEN if no help , hit trip advisor "NOT motorcycle friendly" should do for starters

    Unfortunately the hotel do not care in the slightest, and said to leave whatever review I wish on tripadvisor.............which I will be doing.

    After your advice I used the draft IPC letter and sent a separate letter recorded delivery for the two charges and I have had one reply, so 50 % success so far.

    The reply states that since the Parking Eye v Beavis case handed down by the supreme court on 4th November 2015 confirms that parking regimes which impose charges where motorists overstay or breach the terms are enforceable blah blah etc etc

    Unfortunately I have been away so have missed the £60 date - What do I do now - Can you actually get out of these ridiculous charges since the Beavis case?

    The reply I received was regarding the PCN where the bike was in a parking space, and we were 30mins or so late leaving plus another 10-15 mins unlocking / loading the bike - The numberplate is covered partially, they have included new pictures of the bike and me loading the panniers on at 10.45am and the sign says 10.15am maximum stay on day of departure for hotel guests (Ridiculous!)

    Beavis absolutely does not apply - they'll claim it justifies everything but it only really covers a few specific cases where car park turnover is important, and the signage is so prominent you can't miss it. You were a genuine customer of the hotel, and weren't even taking up a parking space.

    You've still got all of the actual points - the parking company doesn't have the authority to issue the ticket, that there was no contract in place because the signage is insufficient, that as keeper you cannot be held liable under POFA2012 (unless you've identified the driver). You can even claim frustration of contract; had the hotel reception been staffed you'd have left on time.

    Of course, you've appealed now and been rejected, so it's up to you if you want to appeal to the IAS (who promise to reject 80% of appeals).

    Expect everything the PPC and IAS say to be a lie, or at least grossly misleading.

    Sounds like NPE then because not many use 'CCTV'. Or do you mean in fact it was another firm like Excel or VCS or PPS, using an ANPR system that you thought was CCTV (it's not).

    Why...have you not read the advice here? Where does the NEWBIES thread or ANY thread, tell you to bin letters you might need later on? We do not say to do that.

    Read other IPC threads because you appear to be going round in circles and this is already covered. My view is not to bother with IAS and just sit tight, but you would find that with just ten minutes of reading other threads about IPC firms.
    Can you actually get out of these ridiculous charges since the Beavis case?
