cacique, your children dont have to have witnesses, you only need to get your signature witnessed. Your children dont even need to see the form, but if you want to show it to them after you've filled it in, you can do. I would photocopy another part B rather than a plain sheet of paper. its best to do it correctly. If i get a diy will form from wh smith and download the EPA form will that do?I am a single parent and will be leaving everything to my daughter(nowt for anyone else)or shall i go to the solicitor?

There's no reason why your children can't each download Part C and get it signed and witnessed. But each attorney's signature must be witnessed, or the EPA won't be valid.I want to appoint my three children to be my attorneys. Can I send them them the link and get them each to sign part C on separate forms, have them witnessed and send them to me do you think?
Also, I will have to attach an extra sheet to Part B to show the third attorney. Should this be another copy of Part B or just a plain sheet of paper - or doesn't it matter?
With regard to Part B, you'll see that there's space below the second attorney's name and address to overprint the form with "and..... of.....", inserting the third attorney's name and address. Much neater than a separate piece of paper. I used DTP software but MS Word would do it just as well.0 -
The EPA form can be ordered along with an explanitary booklet - in plain English!! - from Public Guardianship Office on 0845 330 2900 all free -- I've just done this for my wife and myself, but take care how you fill out the forms as this is a powerful document, and when the time comes if not properley filled out, it can give away all your rights and possesions i.e. house!0

can someone advise me in this case
a person who is 94 years old, living with his wife who is 80 and son who is 40, if anything happends to my father who is 94 years old whats stage am i am, the house is named on fathers name, mothers name , and 2 sons name
also parents have an account with savings, joint account,
at the moment he resides with me, and i manage all the affairs, but i dont have my name on my parents account etc, simply because there was no need for it at the time, but now i manage affairs,
what should we do, will this rule of EPA apply?
what we dont want is all the money going to goverment, incase something happens

The details aren't very clear, Chiefs, but if you are presently managing your father's (both parent's?) affairs, then you may be wise to think hard about getting each of them to sign an EPA before 1 October so that you (and your brother?) could continue to manage their affairs if either or both lost mental capacity at some time in the future.
When it comes to 'money going to government', you may be thinking of people dying without a will who have no offspring. You parents do have offspring, obviously(!), so that shouldn't be an issue, but everyone should still consider making a will.0 -
If you download the EPA forms (and/or save a blank copy on your computer) and do-it-yourself, I suspect there's a way of by-passing the October 1st deadline. If you, as the person granting the powers sign the form, have it witnessed with your witness adding a date in September 07 before the October deadline date, and the person you have appointed, also signs it and gets a witness to date it adding a date in September 07 before the the October deadline, this has the effect of ensuring that you can still implement an EPA after October 1st. And if you store spare blank copies of the EPA form on your computer) you could change or update your EPA powers any time and nobody would be any the wiser. I suspect that the existing EPA download file will be withdrawn from the website after October 1st, but is this a way around the system? Am I missing something, apart from the fact that you are asking witnesses to append a date which is not correct?0

Primrose, is there a problem with getting the forms completed before 1 Oct?
I know time is running out but in your original post a couple of days ago I pointed out that, not only would you risk invalidating your EPA but potentially risk prison for fraud as well.
(In the above scenario I'm not sure whether you are suggesting anything different, or whether you still mean all signatories would sign after 1 Oct?).0 -
No, its not a problem getting my forms signed. They have already been actioned and safely filed away.. What I'm saying is that there doesn't seem to be any way of checking whether the dates which have been filled in on EPA forms are genuine and this could mean that somebody could, in fact, go through the motions of doing a DIY completion and effectively have it backdated to prior to the October 1 deadline.0
