I am pleased so many have had positive thoughts about this. its not morbid, it is a fact of life. The only thing we can be 100% sure about is that we are going to die. I'm having a Homer Simpson moment! I wish I'd known about the free EPA download earlier. Husband & I have just paid £150 to a Solicitor for our EPA's! :mad:
Have just spoken to Solicitor and they said you shouldn't register anyone unless they have lost mental capacity.0 -
10-66, your solicitor is right. You dont need to register an EPA until you have become mentally incapacitated. By that time it wont be you, it will be your named attorney who registers it. The whole point of making an EPA is to prepare for this possible senario. I'm sorry you have already paid out this money, I wish I'd posted this earlier. But in fact, my mum pais £40 and at the time I thought she had paid less than she was originally quoted. That was before I did a litle surfing. Yes 10-66, I can understand you feeling upset at having paid a solicitors fee for what appears to be a free service but...
The benefits of using a professional are:
you are fully advised of the risks of granting an EPA;
you recieve advice on who to choose as your attorneys;
you receive advice on the wording that limits the attorneys powers; and
the completion process is overseen from begining to end.
In short, you have peace of mind knowing the document has been completed correctly.
What you mighht not appreciate at this moment is that there is now a professional who can be called upon to support the validity of your document if ever challenged by a family member who challenges your possible lack of mental capacity to make such a document.
For a document that is (on the face of it) fairly straight forward to complete it is surprising how many times I have to redo them because the attorney(s), or the donor, have completed the document incorrectly - and all they had to do was sign the document [and in certain cases arrange their signature to be witnessed.] The Court of Protection advice that a surprisingly high number of EPAs fail to qualify for registration because of omissions in completion - and as they are being registered it is too late to correct the problem because the donor has lost mental capacity by this stage.
So, yes you may have wasted your money for now, but you [should] have peace of mind knowing your document has been completed correctly, and if it has not then your family has recourse to the solicitor; that could be priceless!

I'm sorry if I appear a bit dippy here. I've looked through the threads and found this same question but couldn't see an answer to it, so I apologise if I missed it!
I want to appoint my three children to be my attorneys. Can I send them them the link and get them each to sign part C on separate forms, have them witnessed and send them to me do you think?
Also, I will have to attach an extra sheet to Part B to show the third attorney. Should this be another copy of Part B or just a plain sheet of paper - or doesn't it matter?
I would be really grateful if anyone knows the answer.0
