    Somerset- yes, if your parent signs the EPA now ( & informs you that she has done it of course), then if she becomes physically incapacitated ie has a hip replacement and cant get to the bank, then you need do nothing other than present the EPA at her bank ( I'm sure they will phone her or something) and they will check her signature against their records. HOwever, if she becomes mentally incapacitated, you will have to send the EPA to the Court of protection along with £150 and a registration document that you can also download from the Public Guardianship Office- free-. They will probably check with her Dr and/or Social worker. Although it is drawn out, it isn't really too complicated. However, if she waits until after 1st o0ct, it becomes more expensive, and if she doesnt make one at all, well, that will cause untold anguish and expense

  • I shall be sorting out an EPA as a matter of urgency, not only for my 83-year old mother, but also for 52-year old me!

    How do we get this flagged up as a candidate for next week's e-mail?

    good idea Stephen leak, I dont know how to do that. Anybody else know. I'll have a look on the main site. Sometimes I get so engrosed in the forum, I forget to check on the main site. Will post agian if I find anything

  • Tried to download the form but it comes up with download error and tells me to change my preferences, whatever they may be, so the site says you can buy the form from your solicitors or legal stationers. Does anyone know if you can just go into any solicitors and buy one or somewhere like Smiths and how much do they cost?

    The link still works OK for me. It's a PDF document, do you have Acrobat Reader? If so, try going in through http://www.guardianship.gov.uk/ and click on 'Forms and Documents', 'Forms', 'Form to make an EPA'.

    If you don't have Reader it can be downloaded free. Alternatively, they can be bought at stationers, probably not even legal stationers (try WH Smiths?).
  • I have just updated my will and made an EPA. I was talking to the solicitor dealing with it all and he says that the legal profession are desparing of the new Lasting Power of Attorney that comes in on 1 Oct. It is going to be lengthy and will have to be put in front of the court right away.

  • Thanks Katykat - wasn't aware how complicated it all was - will sort things out for us too. Its spurred me on to get a will sorted out as well. Stupid that we've not done in yet as we have two children and we would want to decide what happened to them if the unthinkable did happen.
