Damaged Item, Cant pay for it

Huh?
I am being told on here that I should just tell the seller to collect their merchandise. Soolin, I do appreciate your comments .., but if ebay is telling me I have to return it and pay for postage, surely just telling the seller to come and collect it will resolve nothing? If there is a law saying that this is all I am obliged to do, please tell me so I can go back to ebay with that. Please. This is my point. Ebay are saying I have to pay return postage, I am saying I don't and they aren't listening.
I've listed what's happened chronologically, I've given copies of the communication I have had with ebay.., none of it showing me losing my temper lol. Fair enough you can't understand it, I can't see how but such is life lol. How is closing my account, that I now feel unprotected using, being in a strop?
It looks like Ebay is trying to force me to pay yet again for the defective product.., and pay for return postage, after two failed attempts to pay to an invalid email address.0 -
Lets try and clear this up...
Have you actually paid for the item - yes or no?0 -
I've just seen your edit in answer to Soolin.
If you have not actually paid for this then forget about what eBay are telling you. You are talking to an offshore agent who can barely speak English and is paid peanuts. If you've not paid for the item there is nothing eBay can do, its between you and the seller.
There are several eBay experts here giving you good advice. If you choose to ignore them then there is very little point in asking for advice in this section of the forum.0 -
I have tried to pay twice, through paypal. Ebay told me (see chat above) that it was still pending because the seller had not confirmed their email address with paypal. Then it turned out the email address the seller used was invalid. I sent an email to the sellers paypal email address and it was returned as not valid. At this point I cancelled the second payment, feeling like something suspicious was going on.
I am still waiting for this amount to be returned to my account.
I now don't trust this seller and although they've sent me an invoice over the bank holiday, I haven't paid it. So currently, the item is not paid for. Ebay know I HAVE tried to pay, see chat transcript above.0 -
So why don't you just say to the seller, "Do you want the item back or not?"!Warning: any unnecessary disclaimers appearing under my posts do not bear any connection with reality, either intended, accidental or otherwise. Your statutory rights are not affected.0

I offered to return the item, packaged properly but thought the seller had to pay return postage so insisted on that. They refused to pay the postage. Now they have invoiced me for the item and are expecting me to pay for return postage. Ebay is supporting this. And I have yet to receive the second payment back.
I know this will seem non comprehensible, but I feel like I am just lending paypal money to put in their holding account! I don't know if the third payment will go through.0 -
As stated several times before, ignore eBay. And DO NOT SEND ANOTHER PAYMENT!deannatrois wrote: »I offered to return the item, packaged properly but thought the seller had to pay return postage so insisted on that. Tell the customer that you are not paying for it as it is not as described and if they wish to have it returned they can either send you the money to return it or they can arrange to have it collected at a time convenient to you.
That's it, that's all you need to do. eBay cannot do anything as it is now out of their jurisdiction.
This is the advice you have already been given above by several people and it is the best advice you will get here.0 -
OK, thank you, I suppose I felt I had to operate within ebay rules, persuade them that they were not correct.
Sorry if I seem to be ignoring things, it wasn't my intent. Genuinely don't want to do something that's not legal.
Things that have been posted on this board have made me realise that obviously what seems blindingly obvious to everyone else, isn't to me. I guess I shouldn't be posting on MSE. I love the site, it has kept me going at times but obviously there are things I'm not so good at. Sorry I've wasted people's time (genuinely). Now I know why my son feels as he does. Sorry again.0 -
Pinkshoes asked the question in post #2
It appears not, as ebay are treating it as a return requestHave you opened a dispute for SNAD?
This reads to me that you haven't actually opened any case yet,try going to resolution centre and opening a not as described case this should get you a return label either from the seller or ebay.I have reviewed this transaction and can see that you haven't yet filed a return request for this transaction.0 -

Ebay don't understand when something doesn't go as it should. By you cancelling the payment, you have overridden their scripted response and they don't know what to tell you.
If you have notified the seller that the item is available for collection or that you will return it if they send a prepaid label, there is nothing more you need to do.
As for your son? I'm at a loss as to the last sentence....0
