As far as I know they cannot prove I was driving.

I simply have no idea what the point of the court letter is or what I am supposed to reply. Why don't they just say approved or rejected and ask whether you want to defend the claim?0 -
Invoking non-compliance with POFA thus no keeper liability is a very shaky defence when the OP's other defence is that they were a member of staff who had paid for a permit to park. On the balance of probabilities it's obvious that the keeper was the driver unless there's some exceptional circumstance that can prove the contrary.
The OP's best tack is playing the Scotland card. Trethowans & Aintree have form for going to extraordinary lengths & wasting ridiculous amounts of money chasing multiple parking tickets as the PePiPoo case demonstrates but it is unlikely that they would actually mount a case in Scotland. Some brief Googling confirms that the Civil Jurisdiction and Judgments Act 1982 which gives effect to the so called Brussels Regulations means that a consumer can only be sued in their local jurisdiction.0 -

Some good news today!
I got a call today from Aintree CEO office saying they are dropping the case following my complaint.
It would have been nice to resolve the jurisdiction issue for future advice to others but never mind.
Am quite tempted to stick in a FOI request and try to expose this scam in the media that Trethowans seem to have running at the tax payers expense thanks to Aintree.
Will keep you updated on that.
