I have written to Aintree chief exec at time of first post - no reply received at all!
I wrote to the court applying to contest jurisdiction.
Just received a bizarre letter from Salford CCMCC which says 1 line:
Your case was placed before District Judge X who made the following comments. "This isn't an issue of jurisdiction per se but an issue of location. The Court cannot advise the defendant and he should seek advice'.
I didnt ask for or want any advice. Surely my application is either rejected or accepted? Im guessing this means it is rejected.
What should I write back? Just say that I am going to defend the claim and bill for my expenses (quite substantial coming from Aberdeen).
I am going to email and call the CEO office at Aintree tomorrow.

Yes they can. Its complicated. And expensive. I am aware of a consumer suing a Scottish company successful. The case was eventually heard in England after several hiccups.
If the consumer was in Scotland, being sued by an English company, then I suspect the hearing would be in Scotland, but am not sure.Dedicated to driving up standards in parking0 -

When the case is finally allocated to a court, the court should be in Aberdeen. So it will be them travelling, not you.Dedicated to driving up standards in parking0 -

I have checked with a well-known Scottish solicitor who tells me this is what would happen. He might be wrong, but he knows more than me, so I doubt it.Dedicated to driving up standards in parking0 -
the good news is that the claim figure is lower

It went badly for Aintree too. They ended up paying Trets far more than they recovered. This would be even worse in Scotland, where 'small claims' cases need several hearings, not just one.
