New custom fit blinds, but wrong colour what rights do i have?

HI guys,

We ordered blinds which were made to measure from a local blind company, they took 10 working days to be made and arrive to be fitted. a fair price was agreed, we chose a dark wood colour and confirmed order over the phone VERBALLY where they took a card payment for 10% deposit.

On the day there fitter arrived to fit and to our surprise the blinds were WHITE but still wooden, we told the fitter and he said I'll fit these so you have something for now and advised us to call office to arrange the correct colour. - nothing was signed or paid further than the 10% already paid.

After we called to alert the office of the wrong colour, the owner eventually called and was very blunt and rude, told me you ordered white now pay up i have a voice recording to prove he said, i asked to hear this as i 100% did not order white, he then rudely said FINE see you in court and told me he would delete my number and wants nothing more to do with me!

nothing was signed very unproffessional handling of the matter, where do i stand? all i want is the dark wood blinds we ordered and to pay the agreed price, we refuse to pay for these white ones and would rather hand back for full refund. But the bully boy owner is having no resolution to this at all, i can understand these are made to measure and will cost his business money however it was not my mistake, there was no official order form to sign or nothing all on one phone call.

sorry for the long post any help on what rights we have would be greatly appreciated...

    I doubt very much you'll hear anything from the seller again.
    Not sure how much deposit you paid and if you want to pursue the matter?
    It sounds to me as if he knows he's messed up, but with no paperwork it's your word against his. You also pointed out the error before fitting which goes in your favour I would say.

    Are you sure the company haven't since taken the remaining 90% on the card you paid the deposit with.

    Is it a credit card? Call the company and ask them about a charge back. And make sure they don't attempt to charge the other 90%.

    Letting them fit the wrong colour was a mistake though.

    The total price was 480 deposit was only £48 so not so bad considering.

    it was paid with visa debit card. i think we will cancel card to be safe. possibly was a mistake but at the time the fitter made it feel laid back as if it was easily changed. the fact that we didnt sign or pay on completion puts us in a better position for leverage hopefully.

    Don't cancel the card and think that's the end of it, cancelling the card won't affect a transaction agreed previously.

    Just talk to the bank and tell them you want the deposit refunding and the balance rejecting, for the reasons you've explained above.

    I've been Money Tipped!
    On Thursday of last week, I was supposed to be accompanying my son-in-law to the local County Court over a small claims matter.

    At 8.30 the evening before, the defendant phoned to say that he had just paid the whole amount into the claimant's bank account, including the costs of bringing the claim in the first place.

    I'm told that many claims are settled 'on the courthouse steps'.

    Why not write a Letter before Action to this company stating that they must either refund you the deposit money or you will see them in court.

    A bully like this managing director will usually be able to see that it's cheaper by far to give you back your money than have a secretary type up a reply....

    See this - seems chargebacks can be done on debit cards too.

    Indeed they can, but the bank will probably require the goods to be returned before returning the money.

    No need to go to the Which website, there's a good chargeback article on MSE. ;)

    OP, you could write a letter stating that the wrong colour was made/fitted and offer to agree a date for them to come and remove them?
    I'd be surprised if they did, more cost to them but at least the offer has been made
    The loss to them is far less than £480 and the used blinds are if no use at all.
