Car Dispute Advice Please

    Is the finance in his name? as the car is linked directly to the finance i would guess this maybe the key point.


    If it is then from my view his position is stronger as if he stopped paying then it would be repossed probabably

    Actually the car belongs to the finance company with which he has an agreement with.

    OP, the fact you're currently the registered keep is neither here nor there, if he/they want the car back then they can take it.

    How long have you had the car and do you know how long the finance agreement was for?

    Edit: When I referred to you above, of course I meant you girlfriend. :)

    The finance is in his name, yes.

    I don't believe he'll just stop paying for it, though he might I suppose.

    I'm just trying to figure out how he can compel her to hand it back, as I don't think the police can get involved with a dispute like this and I don't think the finance company get involved in who has possession of the car either.

    ETA: he doesn't have possession of any keys or the like. I suppose he could have it towed.

    Why wouldn't they, until the finance has been paid off it is their car.

    he could report it as theft surely

    Regardless of what happens here, maybe longer term you and your girlfriend should give the car back to him and get her name off the V5. It sounds like even if you resolve the issue now, something will happen again in the future, and again.

    Well because all that matters to them is who pays for it. If it's being paid for, which it currently is, it's not their business who is insured on it or who is the registered keeper.

    It's contracted for 4/5 years I think. It's 2 years old. She's used it for all this time, the breakup was last year.

    She has numerous messages from him, which I think would hurt him legally, telling her he'll pay for it he just wants the car when the contract is up and so on and so forth. Then a month later he's saying he wants it back, a while after that, "No it's fine, I don't want it, you have it, I'll pay for it."

    The V5C is not proof of ownership - as it says on the form. It just shows who is responsible for registering and taxing it. The finance company owns it, and is hiring/leasing it to him until it is paid off, or until he breaks the contract and they repossess it.

    See what the CAB says before doing anything.
    For every complex problem there is an answer that is clear, simple and wrong.

    This is definitely our aim, but for the moment things are tight for her and she won't accept offers of help from me (I suspect because of his behaviour).

    A while back he pulled the same stunt, she cobbled together enough for a deposit for a new HP vehicle and agreed to hand it back, then a day or two later once she'd agreed to the contract and paid for it he said she could keep the current car.

    It drives me nuts, I don't know how she's coping if I'm honest.
