Interview Under Caution-ESA

Hello,

My wife has an IUC for supposed working while claiming ESA. She has asked a solicitor to go with her. We don't know when the date is yet.

Assuming my wife is found guilty but doesn't go to prison. Will her employer be told? Will she lose her job?

    They won't tell her employer but if prosecuted depending on what work she does, it may be she has to tell them as part of her employment.

    It may also appear in the papers and they would have already been contacted by the DWP to provide your wife's income, hours worked etc so highly likely they know or suspect she is being investigated.

    Not sure why you wouldn't know the date of the IUC as normally that is booked in advance, was it postponed owing to her wanting legal advice?

    If they are using RIPA they can also intercept your internet traffic and e-mails including this post.

    You seem to imply that she is working? Is this permitted work or not?

    You say 'supposed working' then go onto ask 'if her employer will told and will she lose her job'......So no supposed about it then, she has been commiting benefit fraud!


    Yes her employer will most probably find out as they will need to be contacted for evidence purposes, what they do about her job is down to them and/or her contract.
    It could very well be they have already been contacted by the DWP..

    I thought some people could work up to a certain number of hours whilst still being entitled to ESA.

    *edit* and under a certain weekly figure but don't know what that is.

    What planet are you on, DWP would not get RIPA authorisation for that.

    Surveillance yes but internet traffic and emails no way.

    It's about £107 per week, but you need to inform them about it.

    Claiming ESA if you work
    Your ESA isn’t usually affected if you either:

    earn up to £20 a week
    work for less than 16 hours a week and earn up to £107.50 a week, for 52 weeks or less (or for any length of time if you’re in the support group)
    This is called ‘permitted work’.

    You can also do ‘supported permitted work’ and earn up to £107.50 a week. This must be part of a treatment programme, or supervised by someone from a local council or voluntary organisation whose job it is to arrange work for disabled people.

    There’s no limit to the number of hours per week or length of time you can do ‘supported permitted work’ for.

    You must tell the Department for Work and Pensions (DWP) if you start doing permitted work. They’ll send you form PW1 to fill in and send back to them.

    Any volunteer work you do needs to be reported. It normally doesn’t affect your ESA.

    Tell the Jobcentre Plus office dealing with your claim if your circumstances change (eg your income changes or you go abroad) as this can affect your ESA.
