EE adding two phones to account without permission
Hi everyone, a bit long winded so hopefully bear with me.
My son (23) went to carphone warehouse and took out a contract with EE for 2 phones for himself and girlfriend, we have all the documentation stated the phones are in his name with bank details credit agreements etc.
My wife also has a phone on EE on checking her bill last month EE has put the 2 new phones on her account.
So first off all my son contacts CPW who say it is not their mistake and you need to go to EE goes to EE and they say it is CPW fault, so back and forth he goes, all we want is change off ownership and taken off my wifes account.
Now my wife contacts EE to resolve the problem as far as we are concerned adding two phones to the account without permission is a potential DPA breach?
EE are now saying they can, transfer the phones onto my sons account because he has failed a credit check. Why they allowed him to have the phones I don,t know? All documentation is in his name etc a mistake perhaps and maybe because he lives at the same address they justed added the phones to my wifes account by mistake?
After countless calls and getting nowhere I was just wondering if we should now be putting in a formal complaint someone has added these phones to my wifes account without permission which I persume is a breach off the data protection act ?

CPW sold the contract, they have to sort everything out.
EE have absolutely no rights to add anything to your wife's account without her consent.
Both are giving you runaround - that's only what they are really good at.
However, I think DPA has nothing to do with this.
Formal complaints is the way to go and a compensation is due from EE.0 -

Unless things have changed CPW have direct access to the EE registrations system, I think the blame and compensation claim should probably be aimed at CPW.
I presume the son was a decline and the CPW salesman saw a way to still have a chance at some commission.====0 -
Well, this would be fraud as all documents and the contract are on the son's name.0

I experienced this a few times when I worked for Orange and I imagine it's the same thing happening now.
As d123 says, Carphone Warehouse has direct access to the EE systems, which means that they process the whole thing, without input from EE. In effect, CPW have connected the contracts to yoyr wife's account. What they usually do when processing the registration is pop in the address and their own systems will bring up any other accounts under the same address. Your wife's, I imagine, will have been highlighted. Then, they usually, in error, add the new connections to the account that's already there.
It is CPW you need to get on to get this sorted, although they will fob you off, I imagine. From EE's point of view, your wife can say the accounts in your son's name are nothing to do with her and they should be able to disconnect them from her account. They shouldn't be charging her for something she hasn't requested. What happens to the connections after that, is really up to CPW.0 -
