Stopping a supermarket from erecting scafolding on my land

    It is a property developer based in Northern Ireland. They are probably working on behalf of one of the big supermarkets.

    Well my advice, for what it's worth, is don't get lawyers involved until you've had that chat. Again, from experience of seeing others, it tends not to end well even for the 'winner' when it's person v person... let alone when it's person v business!

    If you *must* involve lawyers, then leave it as late as possible. Butting heads *does* cause stress, and just now ought to be a fantastic time for you, and a newborn on its way. This isn't rolling over btw, as from your current mood I suspect you'll go the lawyer route in the end anyway but, give yourself as many options as you can for as long as you can... for your sake.

    And also, whatever your personal views, if you do get to have that meeting don't start off with a 'this ain't happening' line, even if that's what you're thinking. Play the game a bit, show yourself open to compromise and see if a compromise can be found. You can always revert to that line later!

    But at least they might have a chat without lawyers, and at least they might think differently after that. So baby steps (no pun intended) and all that.

    Again, years of experience tells me sometimes people won't change their views completely, so no matter how many people tell them not to go the legal route if they're set on it... they will anyway. So in this instance it's as much (in my view) of trying to find the path of least cost to the OP, both financially and emotionally.

    Who knows! If they have a chat they might find out the supermarket intends to go nowhere near their land... or they might find they offer them some cash. Now OK, neither of those are necessarily likely but... better they at least check for free then go all legal on their bottom!

    Yes I think you are right. I think I will still seek legal advice to see if my position is correct but leave it at that until either work starts or someone comes to see me.

    If someone comes to see me I can tell them that I know the supermarket is going to happen no matter what I do but it could happen a lot more smoothly if we can come to some sort of agreement over the use of my land.

    You do know most supermarkets wont have banksman, nor will the lorries stay parked up with their engines running (drivers hours and fuel costs mean they try to be efficient with all their deliveries)? They also have restricted hours for deliveries where they are in a residential area as well as quite tight procedures for noise. They are also quick to act when (genuine) complaints for noise are made.

    A lot of the time, supermarkets are better neighbours than most!

    Just be careful. Solicitors have a vested interest in fighting your case...money.

    They will largely be of your way of thinking as your are giving them the information (it will be one sided) and you are wanting to win. Most solicitors will happily take on work with only a small chance of a win as they will earn the same, win, loose or draw!

    Another way to look at us is that we're realists. We'd save our energies for battles we can win. A good strategist knows they might not win every battle, but it's the war that matters.

    In this case, the war seems to be the same one that many of us fight, which is to own a pleasant place we can call our own in the midst of a changing world. Unfortunately, sometimes that change happens on our doorstep and then we either learn to live with it or move on.

Where I used to live was once quiet, but slowly, inexorably, things changed until it reached a point where I knew I'd be moving on. I couldn't pin it on any one or institution or person, so there was no way to fight it.

    Your change is going to happen more quickly, but it's the same question: "Can I live with this? If not, what's the best way to move on from it?"

    I'd argue that the answer is not to waste energy picking a fight which, even if you win, won't alter the overall course of the war.

    And who knows, once the supermarket is up and running maybe it won't be as bad as you imagine. At present it's a just a 'known unknown;' no more than that.
