Natwest Issue

Sorry if this has been covered elsewhere, I can't see it ..
Too angry ....

I have been a customer with Natwest for a few years now and recently they have started some actions which I am not too sure is totally Legitimate. I'm hoping someone here can assist with Who I need to speak to now.

They have taken Bank Charges from a Negative Balance Account. I complained about this before and they kindly Refunded the Charges stating it would never happen again and they would even change my Statement Date to the 2nd of the Month.
I checked my Account and have now Found that the Statement Date hasn't been changed and they have taken £82 of charges from it. this has pushed it well into Negative Balance meaning that More Charges are being incurred ....
Have they Lied to me and do I have any Grounds to possibly look into a Fraud claim against Natwest ?

I'm not sure I understand what has happened. Though I think pursuing the fraud angle is a no go.

  • the account was at -£3 ..natwest have taken £82 of charges despite there being no money in the account to cover them .. this is Despite their "Agent" saying on Live Chat that they'd change the Statement Date and that Charges shouldn't be taken from accounts with no funds to cover them

Call them and ask them to fix it rather than getting annoyed.

    This is nonsense.

But they do give you advance notice of when charge will be made.

If all bank accounts were only able to take charges when accounts were in credit would result in two things - 1 Nobody would let their accounts into credit and 2 the banks would go bust.
  • If the agent's agreed to the bank not taking/refunding the charges then the bank should refund what has been taken. As to the statement date, there's not enough information to see why this is relevant but if it should've been changed then so be it.

Saying that though, banks can take charges out of negative balance accounts because banks are allowed to take money owed as it's what you agreed to when opening the account. You say it was taken out when the account was £3 od but obviously without looking at your statement it's impossible to say why the money was taken.

Why not go in to branch and see if they can resolve it?

If you went overdrawn you will be charged.

It wont make any difference by the statement date being changed.

Does that include being overdrawn because of the £3/month fee? I always get a text when not enough funds for a DD so can pop up the account but one time I was negative because of the fee & never received a text to warn me. Luckily I happened to check my account that day & topped up before the evening.

I've just set text alerts for below £0 but that's presumably useless also as the alert says "morning balance" and the £3 fee is added later

If you were at a minus figure in your account surely you were attracting unauthorised overdraft charges, which amounted to £82? Do you have an overdraft on the account.?

Natwest do notify you of charges on your account via internet banking and via email so you would have been notified of charges, its not fraud its a payment from probably a overdraft authorised or otherwise used the previous month, you have been given notice of date of the charge will be be taken and this will be taken on that date, could it also be for an account charge for your account, that has taken you into a overdraft so is overdraft charges for the £3 fee?

The bank is allowed to take the fees/charges from a minus figure as I can only assume you have spent the banks money and this is the charge for doing so.

Worth getting the payment back into credit as otherwise you will be building up further overdraft charges for the next charging period.

Speak to Natwest again and get the transcript sent to your email address, or call so can take a advisors name for record.
