    Why waste money on solicitors fees when the complaints process (and any subsequent escalation to the FOS) is free??

    having spoken to them again yesterday it is quite clear that they are in no rush to resolve this, even though they are admitting they made an error.
    Meanwhile I need to get my car back on the road and hence need to insure the sorned vehicle!!!! but I'm not happy taking out a new policy and lying about the cancelled policy statement.

    At this point the solicitor is costing nothing. If I don't escalate the process I could be scrounging lifts for weeks

    Solicitor or not, they have up to 8 weeks to respond to your complaint. Once you have received their final response you can then escalate to the FOS for adjudication if you are not happy with their response. The FOS can take months to deal with your case. Involving a solicitor does not speed up the process. If the FOS adjudicator rules against you, then you can ask for an Ombudsman to review, if they also find against you then your only course of action is through the courts.

    ask them for an email confirming the cancellation was done in error, then you have no need to lie.

    a. because dealing with the FOS requires the same level of expertise as does dealing with our legal system.
    b. because their interests are self serving
    c because some of their staff are incapable of listening and actually understanding what it is a consumer is complaining about.
    d. because their staff can be so blatantly fixed in their own presumptions you are disadvantaged from the start
    e. because I imagine many judges are unaware of the above points and a FOS failure to support you may well work against you in a legal hearing.

    As a insurer employer I am at a loss as to why they cancelled your policy.
    The complaints procedure will identify with your side and rectify the issue.
    As an aside if you recorded a call without telling the other person then you cannot use it against them in any way. Hence why all call centres have an Ivr which tells you about it.
