Thanks for the explanation CM. Where we differ is that you have a far higher regard for PoPLA than I do. My view is that we should try to get as many people as possible to ignore and, if they are up to it, challenge PPCs to take them to court.
I know that many people here think that CC is a lottery, but my experience of it as a landlord has been entirely positive. I suppose that we are writing for different clientele here, you for Brighthouse customers, me for John Lewis Ladies who Lunch.You never know how far you can go until you go too far.0 -

Sounds good...as I said, maybe someone at UKPC has strangled it at birth. Have seen some never make the system before, maybe this will be one that goes nowhere and therefore should not be appealed if it never makes the system.It would not surprise me if she tries to appeal and finds the PCN not recognised on UKPC's system. It sounds like one even they might not upload, if the photos show a Blue Badge and clock.
However, the complaint to the shopping centre or Store Manager this week is the priority to do anyway if you can get back there, with the offending PCN, to demand they cancel it by phone on the spot.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

"Hello Vicki
Thank you for your e-mail.
We do not directly employ the person who would have issued you with this Parking Charge Notice (PCN). If you feel that it has been incorrectly or unfairly issued there is an appeal procedure which you can take up with UKPC. This is outlined on the back of the PCN which you should follow making the points you have made to me but to them."
So I will just follow your advice and appeal in April.0 -

Remind them that - if they contracted UKPC, never mind that they don't 'employ' the employee - as prinicpal they are liable for the actions of their agents at all times. Cushman and Wakefield are the Managing Agents for the Octagon who work on behalf of the landlord of the Octagon and I work for them. Cushman and Wakefield hold the contract with UKPC Ltd.
I am sorry if there was some confusion in my original reply but to clarify the person who would have issued the ticket is not directly employed by us but by UKPC Ltd and would have been a member of their roving team of attendants which visit the centre ad-hoc to inforce parking conditions.
One of the primary reasons we use an agent such as UKPC Ltd is to try to minimise the involvement of ourselves in dealing with parking disputes but at the same time try to ensure that the displayed parking rules are followed for the benefit of all users.
That is not to say I am not interested in your concern or complaint but UKPC have a policy on appeals which I would encourage you to use if you feel this PCN was issued incorrectly re-iterating the reasons you made to me to them and sending them a copy of your Blue-Badge
As I do not have, nor would I be supplied with details (by UKPC Ltd for data protection reasons) of the precise details that relate to the issuing of this PCN there is little I can do to assist you at this stage. However if you can supply me with your PCN number this would be useful and might allow me to investigate this further with UKPC Ltd."0 -
neither UKPC, the BPA nor popla deal with blue badge issues , nor the EQUALITY ACT 2010 issues
the BPA even removed the BB wording from their CoP, disgusting IMHO
but that is a better response as they clearly dont want to mislead you or sound unsympathetic
I would send an email back with the PCN number and a copy of the BB (or a pic of the BB taken on a mobile phone or tablet or digital camera)
you should also state that the MA is jointly responsible with UKPC for this and ask them to get the MA to get the pcn cancelled by UKPC under the EA2010 responsibilities they both have and to confirm this in writing
do not admit to being the driver, just "an occupant of the vehicle"
I could have been the driver, parking up to help you with your BB, my insurance would let me do this legally too , as its fully comprehensive insurance0
