    You aren't eligible to open a Help to Buy ISA if you are not a first time buyer.

    The account T&Cs which you agree to when you apply for one state you must be a first time buyer. If you lie you are committing application fraud. If HMRC realise they can void the ISA. If the bank realise (e.g. from seeing a mortgage on your credit file) they could register a CIFAS category 3 fraud marker (unlikely but possible).

    From what I've read, this is true. You don't need to buy a house to get the interest from the bank, but you have to actually be a first time buyer to get anything I believe.

    However they are treated like any other ISA which means once you start paying into one, you can't pay into any other ISA which is kind of a pain because you can only pay in £200 a month.

    If you are applying for an HTB ISA if you are not a first time buyer, you are making a false declaration. This is a seriously daft thing to do and you will be found out.

    I am fully aware of that and diamonds already mentioned that in their first post on this thread so I don't know why people are kicking up a stink for no reason.
