there should be some clarity, are you talking about replacing the whole fence or just the panels?
further down the line, you'll have to declare that he 'maintained' your fence at his cost, and legally he may be able to get ownership of the fence transferred to him.
The only way to be sure is for him to erect a new, higher fence inside his boundary0
