Ormskirk Parking Ticket - HELP!!

Hi,
I know it says do not make a new post about parking tickets, and I have honestly tried to follow them but since I know nothing about any of this type of stuff, I found it hard to relate it to me. So I do apologise for another boring, repetitive Parking ticket forum!
I overstayed my stay at Ormskirk Two Saints Car Park, by 15mins due to busy car park and shops. Was in queue for 15minutes at least.
I received the first letter and ignored it as I was told my Dad they can't do anything. I then received one from ZZPS claiming I now owed £150 and sounding very scary and now I am panicked! I was ready to pay it and then I stumbled across these forums.
I have tried to follow some of the advice and have contacted Aldi in Ormskirk about it. But now as I am trying to write an email to the original company who issued the ticket, who I think are CP Plus LTD I just don't know how to quite word it.
I used a template you put on someones similar post about Ormskirk, but when I saw it was 2years old, I thought to best check as some things might have changed in that time.
How does this sound?
To whom it may concern,
As the registered keeper of XXXX I'm in the receipt of your parking invoice XXXX dated XXXXX. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) The amount being claimed is not genuine pre-estimate of loss to your company of the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
4) The driver was a regular paying customer when they parked at the retail park on that day
5) The 15minutes they were over was actually the time taken to enter the car park, find a space, park the car, wait in shop queues, then return to the car, return the trolley, leave the space and then exit the car park on a busy midday. Abiding by the the reasonable amount of 'grace time' to enter and exit the car park, which is expected by customers as per the BPA Code of Practice.
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim expenses from you. The expenses I may claim are not exhaustive, but many include cost of stamps, envelopes, travel expenses, legal fees, etc.
Please issue your cancellation within 35 days of the letter, or forward a poppa verification code.
Faithfully
xxxxxx
Hope this finds someone who can help!
Thank you so so very much in advance!!!!
and sorry again to post another one up

your dad was talking through his **** , lol
I would assume that because this is with ZZPS its actually too late to appeal, as you had 28 days to appeal the pcn and ignored it due to stupid advice from somebody who had no legal training or knowledge (you didnt say when the ticket (pcn) was issued but it seems to be some time ago)
it is now too late to appeal, so you need to concentrate your efforts on getting ALDI to cancel the ticket
you can ignore the debt collectors
everything you need to know about this topic is in the NEWBIES FAQ sticky thread at the top of the forum
post #4 tells you about ignoring debt collectors
this will rumble on for up to 6 years if you dont get it cancelled, with a possible court case in the small claims court
dads dont know everything, so in future, ask, on here, or on pepipoo forums0 -
Thanks for your reply!
Glad I asked before sending off my email as it would have been wrong!
So I should ignore the debt collectors, feel like I will just continue to get abusive letters and don't fancy a court case haha!
Does it just eventually go away then?
Eugh so annoying!!!
Shall never listen to fathers advice again!
Thank you so much!!! Seriously helpful0 -
If it gets to court include this in your defence

Aldi just emailed me back telling me to appeal back to CP plus, but as you said its too late. They said they would support it, if I have relevant proof which I would be able to have.
Is there no way of trying to appeal back to them?
Sorry if I am asking easy and silly questions.....0 -
PPC's and debt crawlers are NOT reasonable people ....
they do not care ......
they just want your £££
so send the appeal to the PPC as Aldi asked and make sure you keep proof of what Aldi has said to you .....
if they reject it ... it would show that you had been willing to try ....
if .... iF ....... IF .... this ever got to court the PPC would have a hard time if the letter / email from Aldi was produced ...
good luck

Aldi are simply passing the buck.
CP plus will not be interested and there is no point in talking to their stupid debt collector.
Interesting that Aldi would support it ? Do you have receipts and proof you shop at Aldi ??
You need to go straight to the MD of Aldi telling him that if the ticket is not cancelled you and your friends will not shop at Aldi again and your money will be spent will Lidl instead.

Aldi can't cancel this AFAIK as it's not their land/their contract. Two Saints can, the retail park (Google them).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks everyone!
I am going to try 2 Saints and CP Plus again, just incase they decide to be kind
I don't really fancy having ZZPS chasing me around - I know you say it probably wont go to court, but as I am a teacher I don't want anything on my record or chasing me haha! But then paying it really makes me cross!0 -

Once they're after your money, why should they be 'kind'? Ignore them now, nothing to be gained from contacting CP Plus (but do keep trying 2 Saints.
CP PLUS have hardly ever taken anyone to court.
ZZPS can't take you to court.
YOU shouldn't be thinking of paying.

NOTHING will appear on your 'record', whatever 'your record' means.
Ignore anything further unless you get an extremely unlikely LBCCC from CPP or court papers from Northampton court - don't go lying awake worrying about it.
Teaching a teacher can be difficult - but today is your school day! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
