Parking Eye notice accidently ignored.

Hello All,
I currently live and work outside of the UK but have a car back 'home' in the UK. I returned last week for a couple of days to find a shed load of letters from Parking Eye, and one of their 'debt collectors' explaining that I parked my car incorrectly last June, when I was home for another weekend.
They've got to the point of threatening small claims court, the last letter explained that they're offering a split payment option kind of thing.
Is there anything I can do to get out of it at this stage or have I gone too far?
Thanks.

you need to assume its an LBCCC and try offering a settlement of say £30 or less direct to PE enforcement by email , trying to avoid court at all costs
the sticky threads explain some of this, plus use search words to find similar threads with better advice and the email you need0 -
here you go , a 10 second forum search using the keywords WITHOUT PREJUDICE

Thanks Redx,
In an email to PE do I mention my circumstances or just keep it brief and offer a settlement? Do I need to include the 'debt collectors' in any correspondence also?0 -
I would ignore any debt collectors and send a suitably worded email to PE like I saw in the link I posted where somebody else was in a similar position0
-
I just saw your second comment, thanks, I'll take a look through!0

I would describe the circumstances first because if this was a retail park and you can prove patronage with a bank statement for example, you won't need to make any offer at all. You only need to email ParkingEye and start the dialogue (hold the offer back if you have a bank statement to show them and ask them to just cancel it first).
PE do cancel for genuine customers - all the time, even late - so it's worth rummaging for any proof of spending even from months ago.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the reply, Coupon-mad!
Sadly, it wasn't in a retail park, it was for a housing complex. A friend told me it would be fine, evidently not!0 -
Hmmm, then maybe I would contact them, saying something like:
'I live outside of the UK and this is my address for service of any court papers (give foreign address).
I will not be responding to any debt collector letters - I have recently seen one and I consider it harassment. I am out of UK Court jurisdiction so I suggest you cancel the charge. Do not send further correspondence to xxxx xxxx (UK Address) as I do not live there.
As for the charge/PCN, I am not liable, the driver has not been identified and no PCN was served to me as keeper, within the strict 15 day deadline set in the POFA 2012. Further, I have seen no evidence that any contravention occurred and I am aware of the Beavis case and the fact that these circumstances bear no relation to that case, which is not applicable to other types of 'contract' which turn on their own facts. I require you to send me evidence of the contravention by email so I can make an informed decision, or confirm by return email, that this charge is cancelled and the debt collector harassment of the residents at my old UK address will now cease.
(then if they send evidence and you want to follow it with a £30 offer, do so and the 'offer' email - NOT the above one - has to be headed 'WITHOUT PREJUDICE SAVE AS TO COSTS').PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you ever so much, Coupon-mad - I'll give that a go.
You've both been really useful!0 -
you wont get better advice than that, even if you paid for it
so give it a go, plus let us know the result, even if they throw the towel in
