    The OP's bank itself has to be reported. They executed the chargeback without making sure first that the OP tried to solve the problem with the company directly.

    Under the EU rules though are they not supposed to refund first and ask questions later?

    Why?
    The payment was authorised and the goods/services were delivered, but just allegedly 'didn't do as intended'.
    The bank can even refuse the chargeback if the evidence is not sufficient, and often requires proofs of posting the goods back.
