Visa Arbitration Help

So I bought some items for an online game a few months ago and they did not do as intended so I requested a charge back via my bank, It was only for about £40.
The company that does the online game is based in Romania btw and I am in UK.
Now fast forward a few months to today and I receive an email saying that if I don't respond in 3 days they will escalate it to visa and I will have to pay visa arbitration fee's up to 500 Euros.
They linked some photos of my account and emails from visa which are in Romanian but apart from that I am not sure whether to believe them or not. Anyone can help

Never heard of the fees, but...

If the 'items' 'didn't do as intended', you should have contacted the company in the first place, not the bank. The bank can do the chargeback but it doesn't have all the facts and, similarly, the company has a right to challenge it and to prove to their bank that they are in the right. What's the problem with contacting them now as they request?

These are the two fee's the guys posted in the email.

6.14.8. Opening of an arbitration procedure for contestable transaction abroad - 270 EUR
6.14.9. Administrative fee of the Arbitration Committee for examining contestable transaction abroad - 270 EUR

They requested me to contact them to I assume settle and pay what was charge backed which I don't want to do.

that's probably not a good idea.
You should have contacted the seller originally, not go direct for CC refund.
Not too late to rectify, you should contact the seller now, and detail your complaint.
AIUI in consumer law sellers have to be given the opportunity to resolve a complaint.

Visa Arbitration is not something that a retailer can invoke against a cardholder, only the retailer's bank (acquiring bank) or the card issuer can file an arbitration case with Visa.

The retailer are trying to scare you into paying up. Whether you owe them money or not for services rendered is unproven.

So they are just bs'ing me? best Ignore I geuss
  • I would suggest that you forward the email to your bank and complain in the strongest terms about the merchant's behaviour. Visa would want to know about this and your card issuer can forward the information on.
