Escaping Water to Neighbours ceiling

Not good news this evening.

I've been advised by a neighbour in flat below mine that their bathroom ceiling is covered in water.

It was mentioned that it maybe from my shower and shape of bath.

I didn't have any idea at all that my bath maybe leaking, I only use shower.

Phone call to home insurance tomorrow, (why they haven't updated website as tel is 24/7 -it's not it's only mon-fri 8-6 p.m.:mad:

    Always be certain you are able to (and intend to) make a claim before notifying your insurer of any loss you have experienced. (Whatever the decision on a claim you will have the loss put on your record and will have to disclose it to future insurers asking for your claim/loss history.


    It's unlikely you have any liability for the neighbour's wet ceiling unless you have been negligent.

    As said unless you are negligent then you aren't liabe for damage to the neighbours home. As long as you rectify the problem as soon as possible, they will need to claim from their own insurance

    I'm more concerned their maybe a problem my bath maybe leaking

    Is it possible water from my shower is leaking when it drains via bath?

    You mention it's a flat but also mention home insurance (which I read as your own personal home insurance). Flats are usually insured as an entire block unless it's a share of freehold (and even then it still should be the same policy to save aggravation).

    How many flats are in the block and are you a leaseholder? Does the building have a management company looking after it? Just worried you might have two sets of insurance in place.

    If it is insured as a block the neighbour with the damage should be making the claim off the block insurance and you need to be fixing the leak. If there is an excess then perhaps agree to go halves with him on that but of course that's up to you.

    I live in a flat and here in Scotland things are different. I insure my own flat for buildings cover.

    Hi I have worked in insurance for a number of years and have just left due to childcare reasons. Do you have any emergency policies that cover uncontrollable leaks from shower pipes or baths to prevent any damage? The reason I am asking is because there are home emergency policies that you may have taken out with your existing insurance which is a 247 service that addresses the leak to prevent any further damage or you may have a stand alone policy to address emergencies. Usually standard buildings policies tend to address the subsequent damage and the home emergency policies usually help address the immediate problem whereby there are no delays on assessors coming out assess the damage a temporary fix is normally put in place in the meantime until the main buildings policy takes over, so perhaps check if you have a 24 hour service on your insurance pack and if it covers the leak and shared aspects (some don't). As there are shared aspects in question which regards to the buildings insurance is the main buildings policy under your name? Both yours and neighbours buildings policies may cover for the structural damage to ceilings walls and floors and the repairs on the pipes, if it is a burst pipe then a burst pipe is a standard peril and is usually covered in each of your buildings policies but check there are no omissions for showers or baths and the source of the leak would need to be tracked which property it applies to. Whatever subsequent damage has been done to contents for example carpets, curtains and non fixed decorative fittings etc would usually come under both yours and your neighbours contents insurance its all dependent on what polices you both have in place for your own individual properties as well as the terms and conditions on what they cover.     Think i'm in a wee bit of bother.

    Went the emergency call out route today, arrived in excellent time.

    Immediately mentioned my bath has a crack (looks very thin to me didn't think it would ever be leaking water)

    Anyway bath is not covered under home contents, bath needs removed/replaced with new and possible flooring bath sealer etc.

    I do pay factor fees quartely though callback in 48 hours, not convinced this policy will cover what I require,

    I don't even know where to start.:o

    (I was advised 2009 not to take building insurance as it was covered with factors policy, i'll find out very soon)

    Options are quickly becoming purchasing a bath and paying for removal/installation

    Unless your bath crack has been caused by an accident (and you have any accidental cover), then it's unlikely to be covered by any insurance policy.
