    to get a CCJ she would have to be

    taken to court
    lose
    not pay the judgment ordered by the judge within say 28 days

    after she has failed to pay this judgment, and only then , can a CCJ be issued and then enforced

    if she lost and paid the judgment (approx £200) then the matter is deemed "settled" and no CCJ can happen

    so its the failure to pay the judgment that ends up with the defendant receiving a CCJ

    is she wins in court, its settled and she can claim costs

    she could name the driver, then the driver gets an NTD , which they appeal and then get a popla code, after that the driver can appeal to popla, but POFA2012 protections would not apply , leaving just the other legal arguments

    the ideal way to stop this in its tracks is complain to the landowner (if this is a hospital trust then complain to PALS) and get it cancelled

    you can quote these guidelines at a trust and PALS, which were laid down around autumn 2014 and updated in oct 2015

    I will think I will just try and help her forget about it for now, see how that goes. thanks for advice. I expect to get a few more letters. the ones I got went up to 150 and then down to 80 and forgotten about. this one is different for me as well with the use of solicitors that are established.

    it doesnt explain why she hasnt complained to the landowner, nor why she did not appeal to INDIGO ( vinci park ? ) and then to popla at the beginning of this saga

    oh that's because I said just ignore it from the beginning. I did say about appealing but she wouldn't.
    I just messaged her and try to reassure her that we are one of thousands

    she needs to complain to the landowner asap and nip it in the bud, even if you do it on her behalf and get her to sign it, a pre-emptive strike , based on the NHS guidelines if its a hospital ? (or on mitigation if its a different landowner)

    she wont let me contact them though. I did think about contacting the indigo etc to state I was the driver

    WH, a long established firm, have enetered an area which operates at the very fringes of, and sometimes beyond, the provisions of the law.

    Lol she just messaged me back saying just pay it. I asked why etc its cos she worried that the wh will pass it to litigations team. There they will do the court. Then she worried about fees costs etc.
