Right I now have received notice of allocation to the small claims track. Which I will send off. Should I agree to mediation or not?
Generally we advise to tick 'no'. But you need to read his posting about this otherwise you could end up ticking the wrong boxes or contesting jursidiction or something else that people keep doing because they fail to re-read bargepole's advice on the paperwork.Does this mean it will definitely be going to court,

Not at all, no. This is normal in most cases, then sometimes (but certainly not always) the dropping of a claim happens later.
Sometimes PPCs drop out a few days before a court date, having taken a case up to the wire. Sometimes they turn up and send a Solicitor and the hearing does take place. Hard to predict.
UKPC have turned up and sent a solicitor, particularly in cases which involve multiple PCNs issued to one registered keeper, and they have won some recently. But they have also discontinued on occasion, you never know, sometimes maybe it's a simple case of a court location or date not being convenient to them and the amount being pursued not worth continuing, given the circumstances and defence - or maybe they find they actually have a lack of evidence in some cases and quietly drop those.
Impossible to guess which ones will fall by the wayside and which won't. Maybe it bodes well that yours is about a single PCN. Hope so.how many ppc drop out at this point, out of interest?
It does sometimes happen that cases about a single PCN do not proceed to a hearing. Can't give you a figure though.
But you should proceed on the assumption that there will be a hearing in the Summer at your local court and then you will at least be fully prepared - and any last minute drop-out by UKPC will be a pleasant surprise.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Right thanks. Thread read an form filled. It says to send a copy to the claimant. Is this necessary, if it is I assume this needs to be sent to their solicitors?

Sorry to ask again but do you guys know if I need to send a copy of the Directions questionnaire to the claimant as well as the court?0

If it says so, yes. Presumably the contract address for the claimant is in the paperwork somewhere.0

It says to serve to other parties. Just wondered as it has my telephone number etc... didt fancy the PPC having that and hounding me. Thanks for the advice again guys!0

Hi all. Thanks for your previous help. I have now been given a court date of late summer. I will have a good read about the procedures etc. Any advice. I guess I need to have arguments prepared that go into more detail than my submitted defense?
Seems like I will be going to court so what can I do to help myself win. I don't want to be made to look a fool when their solicitor takes apart my arguments. Have any of you been to court and won?

As it's UKPC have a good close look at their photos in case they've altered them - e.g. is the background and cars behind, the same in two photos purporting to be from two different days? You may have to wait till you get their actual evidence bundle (when you send yours - the court will have directed you as to when this must be done).PRIVATE 'PCN'? Right, its time to do my full defense. Just need a few things clarified.
My defense posted before. Does this need to be elaborated on? If so what sort of thing do I need to add in, as it seems quite comprehensive. Is it just to pull together and print out the documents quoted in it?
The witness statement, I was sure I read a guide on what to include but cant find it after searching, can anyone help?
When printing and providing documents do I need the full doc or are just the relevant paragraphs needed?
Any help will be appreciated, as I am at a bit of loss of what I am meant to be producing, even after lots of reading.
