Small claims - against the police?

  • Has your friend actually made a complaint yet against the police force involved? Why can he "only speak to one specific officer"? If he's made a formal written complaint he doesn't need to be trying to speak to anybody. The police should be dealing with it. They still have a duty to take appropriate care of personal property they seize.

As regards the OP's example above, if the police committed property damage on the wrong house during a drugs raid, of course they'd pay for the damage. Does the OP seriously think they wouldn't?

A formal complaint should be addressed to the Chief Constable of the force in question.

Well he's trying to get in touch with them but apparently he can only speak to one specific officer.

So he asks when this officer is working & is given a timeframe.

So he calls only to be told (time & again) the officer isn't in.

    Convenient.

Then explain to the operator and get him to call you back.

I haven't missed that fact at all...

    I also haven't missed:

The friend was in a car which had weed. Even worse is that the friend appears to be the driver! Despite the fact that friend was not carrying it, and the protests of the mate, the friend still had possession "whether they're yours or not" because he was the driver IN A CAR WHICH HAD DRUGS!

You've misunderstood the part in bold. It does not mean you will be charged if you are with someone else who is in possession. It means you can be done for possession even if the drugs belong to someone else and you are in possession of them (ie so you can't say "but they don't belong to me" as a defence when caught with drugs). Its a common defence for those caught with drugs (or at least, they seem to think its a defence)

    Your comment of:
Now assume the small bag of weed is a 2kg stash of weed.
gave me a giggle though. 2kg of weed would probably be enough to fill at least a carrier bag. Plus 2kg would undoubtedly see you up on charges for intent to supply rather than just possession.

Not entirely convinced the friend wasn't aware he was carrying it though. It stinks like sewage, its very pungent even in small amounts.

    As promised,

Bang em up guvnor, menace to society. Pedalling drugs to kids is wrong.

(nothing against your post by the way, which makes sense)
