Scotland PPC, How to avoid CCJ equivalent if moving?

Forum - I feel i have learnt so much by reading up over hours about PPC.
My question is brief and hopefully doesnt cover old ground. I as registered keeper have long running battle with VCS in Dundee (many many tickets) and they will not win (its a nominated space in my apartment complex).
I have the endless debt collecting mail but have ignored all correspondence (Scotland is pre-POPLA effectively). They have to prove who the driver was (and cant!). I will be moving later this year, i dont want a default judgement against me but nor do i want to engage them after ignoring them? Whats the best way to play this?
Thanks in advance. P.S. apologies if this is covered already

You can either set up mail forwarding until it expires. Or you can write to them stating that you know you are in no way liable but to avoid them trying to get a default win, your new address is now _____ where you can be reachable, that a copy of the letter has been kept along with proof of postage.
I'm not sure what happens in Scotland court wise if a case is made and goes undefended. It's probably not a CCJ as it's not a county court.0 -
Thanks Herzlos - I dont fancy Royal Mails auto forwarding for 5 years - hate the idea of prompting the letters by making contact but sounds like that might be the only way to avoid default.
In Scotland as they have to prove the driver I wonder if default actually exists? Surely they need evidence to demonstrate who is liable (and not just RK?).
Anyway Herzlos - thanks for that rapid reply.0 -
It's known as the Sheriff Court, and they issue a Decree. You can either set up mail forwarding until it expires. You can apply for a Recall of Decree, which is the same as a set aside in an English court.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -

AFAIK it's only possible to have mail forwarded for a maximum of two years i.e. you are allowed one 12 month extension on an initial 12 month redirection.GEORGIEPORGIE wrote: »Thanks Herzlos - I dont fancy Royal Mails auto forwarding for 5 years0 -
Thanks all - I will take the advice of the forum and just inform the PPC of my new address so they have no excuse. I wish there was a way i could charge them for all the hassle - particularly as in Scotland they dont appear to have won ONE case.0

Do u not have any close relatives or friends that still have a Scottish address that u could pass onto the ppc. That way you wouldn't be alerting them to your new circumstances.

Lawson Coull & Duncan in Dundee have been defending most of the VCS cases up there. Why not get them involved early and get them to write to VCS giving their offices as your address. Small fee for peace of mind. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

I'm staying in scotland but with the number of PCN's i have (>30) I wouldn't put it past the PPC to try to take to court - wouldnt want to wake up one day with a decree (even though these guys havent a chance in hell up here)... No RK liability, a space designated for my property and terrible terrible signage.... haha0

thanks for this suggestion. You are right it would give piece of mind for a small fee (admittedly i dont want to have to pay anything in dealing with the scam of VCS. Will certainly consider it0
