Currys broke tv in transit advise please

Hi just after a bit of advice. My aunt has a care plan with currys on her Samsung TVs which is 8 years old been paying £7 a month. It was collected last Wednesday as something had broken inside and needed new parts. It was supposed to be returned today however after waiting all day we had to call them.

To be told the to had been broken (screen smashed) in transit and have been offered £255 the tv is a 42" Samsung so there is no way we will get another one. Where do we stand as far as I am concerned they broke a tv that was working upon repair. Help please 😩

You're entitled to be put back in the position you were before they broke the TV, ie, having a used 8 year old TV, or it's value. I think £255 is fairly generous for an 8 year old 42" Samsung.

Is the £255 a cash payment or is it in the form of credit for use at Currys?
If it's a voucher then there is something like this:

both of which will probably have a better picture than an 8 year old set.
If it's a cash payment, then there are plenty of retailers who will have TV's of around 42" for a similar or better price.

It would certainly be worth your aunt contacting Currys again and asking if they would consider raising the amount offered, something that they may well do.

In fairness at 8 years old it was probably looking towards the end of its life anyway - maybe see if they'll pony up a bit more, but she can get a very nice branded 42" telly for that, effectively a new for old replacement. Were there any special features that'll be unavailable on the equivalent models which she can use as a bargaining tool?

Thank you will need to have a chat it's just such a shame there was not a mark on it it cost £800 brand new but suppose the price of TVs has come down. Think it's bad service that they didn't even call to advise so maybe there is a way of getting a bit more from that angle

£672 of care plan payments on top of the TV cost...

I would be pushing for more than £255...

It would also be worth looking at the cost of a larger screen, they have made the frames so much smaller that we replaced a 40" with a 47" and it only takes a cm more space in the room as the new frame is barely there.

I'd want a bit more than £255 too, if it had failed on its own and was untepairable it would be one thing but when they have broken it completely they should give a bit extra as good will.

If you can get a bit more you could look at http://www.currys.co.uk/gbuk/tv-and-home-entertainment/televisions/televisions/samsung-ue48j5200-smart-48-led-tv-10138425-pdt.html

If you can get a cash payment can I suggest going somewhere that offers a 5 or 6 year guarantee as standard, such as John Lewis or Richer Sounds? She'll save a fortune in not having to pay out for the additional policy.

It could have been brand new in the box, but the fact is it's 8 years old and has depreciated significantly in value. I also think their offer is very fair for a 8 year old TV.

It's hardly crime of the century, it could be that stuff like this isn't recorded until the van returns to the depot and they would then inform you the next day or something (as likely by the time the van returns it's pushing 7 or 8 pm)...

You can try and get more money, but at the end of the day I think what they've offered already for something that's nearly a decade old is very fair.

The age of the TV is irrelevant. This is not a SoGA replacement, it's bound by the terms of their care plan. These state:
"If we cannot readily and economically repair your product you will be given a voucher to obtain a replacement product in one of our stores. The value will be based on an equivalent or similar specification product up to a maximum of your original product purchase price."
ie in this case a new-for-old replacement.

Agree with the above. Is there something these TVs don't have that she needs? Otherwise they would look to be a reasonable replacement.

If there's a TV in Currys that she thinks is the equivalent specification, she could ask if it's possible to get that one. She may have to justify why she wants that specific TV though.
