At the moment its been left that they cancelled the fence installation Friday and are looking into proving its their fence, we are happy its ours so the onus is on them really to show otherwise.
Please do come back and keep us posted as it will be interesting to see how it plays out.
It can be a difficult issue to resolve and it is important to differentiate between ownership of the materials themselves and the responsibility for maintaining it as previously mentioned
Bear in mind also that you also told them they could have it so it will be interesting to see where your neighbour looks to take it next (if at all)“Official Company Representative

It was just a light-hearted suggestion.moneyistooshorttomention wrote: »That's one way to help figure out how well (or otherwise) the neighbours are thinking - if that boundary is very near to their house (ie because the resultant tree roots would be near to their house too).
There are many other possibilities, better or worse, and that's how things go when one neighbour or the other has their plans thwarted.
FWIW, I think the OP had great deal there in the chance of a new closeboarded fence, with the nice side facing them. I'd have accepted that, soon as wink.0 -
Giving them the fence was wrong on our part, we were pushed and just wanted an easy way out but that didn't happen any way !
We've had a structure attached to the fence for years, if they believed even in the slightest that it belonged to them they would have requested it was removed long ago. We want to keep the structure which wouldn't be possible if it became theirs.
As I've mentioned the previous neighbour accepted it as belonging to our property, until we refused to increase the height so did the current neighbour. When they couldn't get what they wanted she's made it an issue, if they truly just wanted privacy why not do something about that years ago when they moved in? (And why remove a huge hedge that gave such privacy a few months ago) Why bother trying now to prove ownership if they've been happy to accept it as ours for all this time ?
If I thought the issue was the fence I'd agree letting her get on with it would be the best option but I think it's about control and pushing boundaries of reasonable behaviour.Bow Ties ARE cool "Just because you are offended, doesnt mean you are right" Ricky Gervais

Tell them to erect a fence on their side or erect one in the place of the current one and gift it to you!
Then you'll know if the issue is the fence!0 -
our issue with the last place we lived....the boundries where all ours and when new neighbours moved in to a property that hadbeen in a time warp...so it was obvious that it was almost always going to be a lot of up dating...its was actually horrendous for several years and drove us away along with the other neighbour...
The adjoining aboundary was high hedges in the front garden in between was a low wall along the house as our source of light then carried on to the back garden a very high fence.noting that next doors property was a least one metre higher than ours...out of the blue the guy turned up in our back garden stating he wanted to erect a 6 foot fence where the low wall was....completely ignoring our protests of the light situation in our Kitchen would no longer be there....he never ever raised his voice but never stopped stating that he felt all would be fine....luckily be found we had light protection and enlightened him to the fact in writing....so it never happened..we warned the next occupier to this fact....he lived for a while in a nightmare situation with what seemed ok people....they where is some ways but o o so incredibly selfish...regards Dianne...an inch turns into a mile if your not careful0 -
Thought i would update, after further letters back and forth where they failed to provide any actual proof but kept changing the reasoning why they felt they owned the fence we told them we would not respond to any more letters and considered the matter over, they were taking a complaint to land registry as they felt the deeds must be mistaken and we did not wish to be involved.
We've now been contacted by environmental health to say they have received a complaint about our dog barking :wall:
Still no fence erected on their side of things, as we suspected the fence was not the issue.Bow Ties ARE cool "Just because you are offended, doesnt mean you are right" Ricky Gervais
