My solicitor awaiting documents for nearly 1 month

    If a probate issue arose, the vendor's solicitors might simply 'stall' till it's resolved. So the failure to return the documents might be for that reason.

    And probate can take months if issues arise or if family disagree.

    Or it may be nothing to do with probate.

    If a contract pack has been issued I doubt it would be a probate matter.

    Even a basic secretary can notice different names on the title and who the client is!

    More likely to be nhbc/share/insurance certificates from the freeholder.
    Currently studying for a Diploma - wish me luck :)

    thanks for your help everyone, its really appreciated. I think I'll give my solicitor a ring tomorrow just to clarify the probate questions to rule it out.

    When you phone just ask them specifically what they are waiting for.
    Then get on the phone to the EA and tell them to get the sellers to sort it ASAP.

    I was on with mine today and also EA, my solicitors just said its 2 property certificates and the ground rent information (not sure if its certificate or document) and that its the same things they have been waiting on for the last month. I got straight onto EA and asked them to chase it with the seller (did the same 2 weeks ago for the same thing) but EA is now saying that the vendors solicitor has already requested it and is waiting for it to be sent to them (the 1st time I chased it I was told they would get onto seller)

    EA also said to me that we are down for completion at the end of April...I said no we aren't, as my solicitor said if this stuff comes through this week they will be ready for us to sign and exchange next week then complete 5 days later - and that I thought completion was decided between us and seller. I didn't think EA had any input in completion and was abit taken aback that they brought it up to me on the phone - seemed like they were trying to imply we had plenty of time as we aren't due to complete til end of April - Although I could be wrong and reading too much into it!

    Sounds like its paperwork coming from the freeholder then.

    EA has nothing to do with dates.

    No I didn't think so either - thanks for clarifying!

    Think I'll still give my solicitors a quick ring tomorrow just to put my mind at rest about the probate issue. Apart from that all I can do is patiently wait I suppose!
