Help please! Fined for not being able to pay.

OK so I was parked in liverpool on seel street (which i had been doing for 3 consecutive weeks) and one day, when i started work at 5pm, I paid for my first hour with the guy in the hut. This i did every day anyway as you have to pay them until 6pm. I have always been told to pay via the machine once i finish work as it s only £3 for all night anyway. I finished just before 7am aand the machine swallowed my money as it was not working. so i couldnt get the ticket. (as it is parking eye, its automatic number plate recognition). The only number i could call was an automated pay number so i chose to do it online instead. By now it was just before 06:55am and the website only allows you to pay up until 8am. As a result of this, it would only allow me to pay for one full hour. Which i did to show i at least tried to pay! I have the text confirmation too to prove this. I literally tried everything I could do to pay and paid as much as I could. Now, for the sake of the £1.50 they literally wouldnt take off me, they are asking for a £60 fine, which I appealed and the rejected despite me sending them copies of all my proof. I can appeal to POPLA now but if they reject it then i have to pay even more. I feel like they are purely taking the mickey. I was spending £15+ a day to use this carpark every day for 3.5 weeks. What is my best course of action here? Please - all advice needed. I have 12 days left to appeal or pay. I really feel i shouldn't have too pay when it wasn't my fault

I am unable to read all that wall of text, so have split it up , please do this yourself in future (with paragraphs), thank you (so its easy to read)
you also used the f-word there (highlighted in red) its not a fine , its an invoice
you now need to appeal to popla and have about 28 days to do so (or less if you didnt come here right away)
read post #3 of the NEWBIES sticky thread, draft a popla appeal based on the linked examples and post it here for further advice and help, MINUS any personal info
and check your expiry date on the parking cowboys webiste, using their popla code checker, dont miss that deadline0 -
ok sorry, I didn't realise about the paragraph, I am just worried so typed it out as I thought of it.
As for the 'f-word' ... that is what is stated on my letter and I only have 12 days left to appeal according to the letter i received two days ago. It said I have 14 days from the date of that letter to do so as I already appealed to parking eye themselves once.
I've never dealt with this before and I am beyond reluctant to pay however I do not fancy going to court or anything either as I can barely afford the fine. Let alone court fees.0 -
Barry Beavis failed to pay his parking invoice, went to 3 courts and lost to 10 out of 11 judges, so it it serious and we want you to avoid court by going to popla
and there will not be the word FINE on any of your paperwork , not at all
it will say parking charge notice or similar, which is an INVOICE
no way will the word FINE be used because they are not allowed to use that word , only a judge or a court can "fine" you, certainly not PARKING EYE
so you need to get your popla appeal sorted, plus make a complaint to the LANDOWNER of that site and complain bitterly, insisting they tell PE to cancel this invoice/charge
check your expiry date by using the popla code on the parking cowboys website, tell us when that actual expiry date is (do not tell us the popla code)0 -
Don't panic. Follow the advice given on this forum by experienced posters like Redx.0

Also sorry - I am just flustered. More annoyed that I gave them all the evidence of paying for as much as all of their services would allow me to and still refusing me. It just seems like a cheap way to score some ££££'s out of me.
I cant find the expiry date, the website crashed when i tried. (typical) I am so useless at this stuff!
Think I need somebody to give me a good hard shake to get my head in the game >.< I actually am super appreciating the help though0 -
you can ask the attendants
you can check the signage
it may be the creditor listed on the NTK
that NTK wont have the word FINE on it at all , you made that word up yourself
you could try googling it
or you can pay the LAND REGISTRY a fee to tell you the landowners details
try that website again using a different browser, like firefox or opera or slimbrowser or slimjet (all free)
then let us know that expiry date
then start work on your popla appeal draft
I assume you have given away who was driving in your initial appeal ?
ie:- you blabbed and gave them too much info ? more like a witness statement for the claimant rather than "no comment" from the defendant (you) ?

Is this definitely ParkingEye? Can you confirm please. Is it not just NCP?
Unlike ParkingEye to have a 'man in a hut' and when I Googled 'Seel Street Liverpool parking' I could only find stuff about an NCP car park?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry, i was on nights at work! It was definitely parking eye. It is the little carpark that is opposite Zanzibar and on the same street as Alma De Cuba in Liverpool.
There is a hut that operates from 8am until 6pm and then you have to pay via the machine for any time you stay between 6pm and 8pm. It is £1.50 for an hour or it is £3 for the full night.
I am a total rookie. I was so convinced I would be fine because I had all the evidence that showed i tried everything in my power to pay but nothing that they provided helped me to do so. Ive got myself into that much of a tizzy over it Im now tempted to just pay the £60. If I go to popla and they reject me too then it will be at least £100.

Just sit back and take a deep breath ! All the above is good evidence on your part, but you need more to appeal to popla. Have a read on this site to understand what is required, then come back for more help. Why on earth would you want to give them £60 of your hard earned money just because their machine wouldn't accept payment.0 -
I know but i've done a lot of reading on this since and I think I have actually given much more information than I initially should have. Looking at people's similar experiences, I do think that I will fail at an appeal with Popla aready like most other people have done before me.
I just wish I came here first instead of being so hasty to make an appeal in the first place. Should have thought it through a lot more. >.<0
