Hi All
I have just received a notice from smart parking and need help
i dont know where to start someone visitied store petAhome @ the time stated had a look around about 20 mins discussed a tank with the guy then left the car park in the car they returned later after going swimming to purchase the tank to which they have no recpiect but a card payment showing this on there statement
what should i do ?

i have read that and do not understand what to do as the entry and exit times are from different visits they enter @ 16:26 then left 20 mins latr re arrived @ 18:30 and left again @ 1842 2 DIFFERENT visits0

This is called "double dipping" and is far too common. Lots of reading here.

Complain in writing to your local Trading Standards Department that their ANPR equipment is faulty and that they are attempting to obtain monies by misrepresentation. Copy to the BPA and appeal to the PPC using the narrative you have told us.

If they reject your appeal, (unlikely imo), they are calling you a liar and you can appeal to Popla, where you will almost certainly prevail.
You could then, if you were up for it, warn them that, in the event of Popla dismissing the case, you would be invoicing them for your time dealing with the matter.You never know how far you can go until you go too far.0 -
use the blue text BPA appeal to not so SMART Parking ! (post #1 of that Newbies sticky thread)
add a note that says that "as keeper I have checked with the driver and 2 short visits were made that day and the vehicle was not parked for the whole period shown on your invoice and so I expect you to cancel this incorrect invoice after checking your computers and camera pictures"
DO NOT admit to who was driving, do not imply it either, so say nothing about what happened or who was driving, just the blue text appeal and add that line in bold above
as this is a "double dipping" case, they have conveniently missed out the first exit and second entry, so as keeper you are telling them this, but you are under no obligation to name the driver and it would be foolish to do so , so no words like "me , myself or I" are allowed in your appeal (you are appealing as keeper to the postal notice)
come back and tell us they accepted this, or if you get a popla code come back and study post #3 of the NEWBIES sticky thread and look at examples of popla appeals, but ask for further help once you have formulated your draft popla appeal

go back to store petAhome and tell the manager that you will be returning the tank if the parking invoice is not cancelled and you will buy from a competitor who does not harass its customers :eek:

i have just rang pets@home ive been told by the manager he will email the company and i should know from them on monday
if they refuse his request should i appeal direct as advised by RedX ?0 -
Still appeal in tandem with the retailer saying they will intervene.
Until and unless you get confirmation from smart that your charge has been cancelled you should continue the appeals procedure.0 -
as mentioned above, use the appeal in the manner I described, AS WELL as this complaint to the retailer , one or both of them should bear fruit, but never assume these people will do as you asked and so cover yourself with the online appeal
its imperative you dont give away the drivers details so alter post #1 using EDIT and change it to say what THE DRIVER did (hint) ! (ie:- the driver visited etc)0 -

I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
