Problems with BT & USwitch?

My boyfriend recently signed up to a new BT deal via USwitch with Unlimited internet - he has high internet usage due to being a gamer & a primary school teacher. His second bill (not his first bill which was as he expected as apparently BT operate over a 2 month average? Is this normal?!) was £30 more expensive (deal is £37.99/month inc line rental, unlimited internet & youview box - deal is still on USwitches website) because BT say he only signed up to a 40GB internet package which he disputes, they have told him to ring USwitch & USwitch have told him it's BTs problem. He would never have chosen that package knowing that he has high internet usage.

I am just wondering if anyone else has had a problem with BT and USwitch not communicating properly? Is it even a problem with USwitch or is it just BT not wanting to provide him with the service he selected? What should he do in this instance?

    Are these charges for excess data over the 40gb cap ??

    What is the breakdown of costs on the bill .
  • Yes, they are claiming they are for excessive Broadband usage, which would be fine but, my boyfriend is adamant he did not sign up to this package.
  • USwitch probably get a backhander from BT ?

    I understand (I am not a Solicitor) the rules related to distance selling and subscription contracts allow for a cooling off period for this very situation. BT would have posted and/or emailed the terms and conditions of the agreement with a statement letting you know that if the agreement is not in line with your expectations then you could cancel (there may well have been charges associated if you had used the service before cancellation prorated for the first period) within the specified timeframe.

    I appreciate this is of little help to you at this late stage so may serve little more than a lesson for the future. Make sure you are fully aware of the obligations of a contract before you enter into it.

    If you have got the time and energy to have a falling out with someone (and life is really to short in my opinion), maybe you should;
    1. ask USwitch if they had actually presented the offers with best outcome for customer.
    2. ask USwitch what commission they got from the referral.
    3. take their response and complain to FCA (who "regulates" USwitch) and maybe also complain to the CMA (for good measure).

    If you can recall how your Partner ended up on their site (email marketing, SEO, direct, other??) there might also be the option of complaining about that too... if you are the sort that is given to complaining.
