Orange contract

Hi
A 2 year contract with Orange ended in 2012. Phone was a xmas present 2010 to an ex girlfriend. Even though I phoned and sent letter cancelling, girlfriend stayed with them but they still sent letters to me and now they want £20 cos she left them sep 2015.

They are acting as though I didn't cancel.
In any event
1) is there such a thing as a rolling contract?
2) did I really need to write letter cancelling with a months notice ?

Help please

bob

I assume she stayed with them on the same ( your) contract.

Yes, at the end of the 2 years minimum term it reverts to a monthly rolling contract.

Yes you have to give 1 months notice by either phone or letter depending on the network.

If the contract was really cancelled, your GF wouldn't be able to "stay with them" with the same number (unless you instruct them to switch to PAYG that obviously wasn't the case).

Just an FYI for the future, phone contracts don't end, they aren't fixed term but have a minimum term.

    Yes

Yes, you should have written and given notice to terminate (in a manner that supplied you proof of doing so, or you should have phone and obtained a PAC (which you would then use to cause the line to terminate) or give the required notice over the phone.

Well, not all providers require a written notice. IIRC, some even don't allow letters for this - possibly because they have no means of making sure that the letter is genuine.
You may terminate your Contract to expire at any time after the Minimum Term by giving us at least one month’s notice.
It doesn't say that the notice has to be written in this case.

Generally, a letter, even sent by a recorded mail, doesn't prove anything. The only proof is a confirmation letter from the provider or the final bill that all leaving customers have to make sure they get.

I'm not even sure that Orange accepted cancellation by letter? I remember them insisting that anyone wanting to cancel had to clear their security check first?

They did use to allow cancellation letters to the Darlington address iirc, but as said, you need to be able to prove its been done, which would really need the confirmation letter, as Grumbler says.
