Have I Been Compensated Enough?

Hi,

I was delayed last August on a flight out to Cyprus from Manchester Airport for 21 hours and received £560 in compensation. We flew with Thomson and we had to chase the compensation rather than them admitting error and coming to us.

The only reason I ask is after recently speaking to someone they told me that they received £660 for a 3hr delay to Boston with British Airways.

I know the distance to Boston is 1000 miles greater than Cyrpus and the flights would have been more expensive but looking at the length of the delay the difference seems massive!

Can anyone help and advise?

    How many passengers? Great circle will provide distance and I presume Paphos which is 3417km.
  • 2 Passengers to Cyprus, not too sure about Boston trip, 2 maybe 3.

    So 2 passengers due €400 each = €800 and given £560 this means an exchange rate of 1.43.


    Boston has no bearing on your claim whatsoever.

    If someone has received £660 for a 3hr delay to Boston via BA an i've received £560 for a 21hr delay to Cyprus from Thomson, is this fair?

    Suggest you look at the law itself - EU261/2004 - compensation is a set amount based upon the delay (in your case over 3 hours) and the distance (in your case under 3,500 km). Whether it was 3 or 30 hours makes no difference ....Boston is over 3,500 km, Paphos is under 3,500. I hope you get the point. Whether it is fair or not has no bearing on your claim.

    111KAB has explained that your legal entitlement to compensation is for 400 euros per passenger for a flight that distance. What someone else got in different circumstances has no bearing on your legal entitlement, obviously.

    You've pointed out what some think is a flaw in the regulation - that the compensation levels are basically determined by distance, rather than delay. So a three hour delay from Cyprus to the UK attracts exactly the same amount of compensation as a 24 hour delay. But a delay over four hours or greater for a flight over 3500km gets 600 euros (if the flight over 3500km is between 3 and 4 hours late, you only get 300 euros though).

    Congratulations on your compensation. The fact that you got without any form of resistance or procrastination would be a bonus to many here.
