Santander refuse new mortgage

Hi all.

Here's a weird one.

I have had a bank and savings account with santander for over 20 years, plus two past mortgages - the current one for over 7 years. Never missed or made a late payment.

I have had a ccj, not for bad debt but had to go to court as I belive I didn't owe the money, obviously I lost. The ccj comes off in mid April, six years have passed.

I have just asked santander for new mortgage as I want to move house. To my shock they have declined it! There reason is that they go off the satisfied date not the judgment date. The satisfied date is two years after the judgment date as I appealed.

I'm dumb struck as I think I am model customer, no debts apart from current mortgage and over £15k in the bank.

How can they go off the satisfied date as once it's removed they won't know what the satisfied date is!

Obviously I'm going to complain, plus the mortgage adviser in branch I was dealing with was far from helpful, they never returned my calls or emails as went on holiday twice without telling me or working on my application. The whole process complete going in the bank to getting a decision took 4 weeks!

Any thoughts?

    You probably are a 'model customer', just not the model Santander want.

    There are plenty more lenders out there.

    You're not a model customer, you have a CCJ.

    There will be lenders for you, but not Santander.

    No point complaining in my opinion, you don't meet their criteria, its that simple

    I was wondering what plan B is at Santander when the mortgage adviser goes on holiday.

    Do all mortgage applications stop for two weeks?

    Apparently so!

    Was this even an application though? Surely the AIP was rejected

    No you are not. The majority of the population do not have CCJs. You failed to pay a debt. Not the activity of a model customer.
    There reason is that they go off the satisfied date not the judgment date. The satisfied date is two years after the judgment date as I appealed.

    Which is logical. People appalled by getting a CCJ (which is most people) would look to get rid of it as soon as possible. Hence the satisfy date is more important than the judgement date.

    So, in the space of 4 weeks, the mortgage adviser managed to go on holiday twice?
    In reality, the bank based mortgage advisers do little more than type your application in and let the rest of it be controlled centrally. Do not mistake the workload they have with a mortgage broker. Indeed, a bank based adviser would really only need to be there to submit the application and answer any calls you make. Them not being there would irritate you but it wouldnt hold up the process as someone else would fill the role (even at a minimal level).

    You will probably get £25 or so from Santander for service (even if the service was good, banks are throwing money at people at the moment). However, you need a dose of realisation that an unsatisfied CCJ is a debt and it is a bad debt and it is not something a normal model customer would have. It is a very big negative on a mortgage application. It won't stop you getting a mortgage but you will not have the wide range to pick from that a normal model customer would have.

    Nothing weird in the slightest. For a creditor to resort to going to court in order to recover a debt issuing a summons is a last resort. For a court to issue a CCJ. The court has to be satisfied that all other avenues have been exhausted and that due process has been followed.

    A CCJ tells a lender a lot about you as a potential borrower. Hence why lending criteria is set accordingly.
  • Complaining is a waste of time, you don't have a divine right to be approved for a mortgage with them.

    The best thing you can do is move on and find a different lender that you do fit criteria with.

    I think most of you are missing the point and are confused.
    The ccj is not for not paying a debt but if there was a debt in the first place.

    Long story short, put my business up for sale with an estate agent, sold it privately thinking I wouldn't have any issues. Apparently I was duped into signing a sole selling contract that i wasn't aware of -took the word of the agent when he came and never sent me a copy. Anyway turned out the estate agent has done this to a lot of people yet the court found said I had to pay them.
    When they did I paid, so NOT a ccj for not paying.

    Having a bank account for that long and clearly showing a good income plus paying my mortgage on time all the time, for the past ten years, I believe makes me more than an average customer - especially given the keep pestering me to take a credit card and other credit products.

    Given I've had this all the time I've been with then and it come off soon I feel the 'human' touch would have been nice and basica customer sevice.

    I understand that different lenders have different criteria but I should have been told this in the bank when I spent two hours doing the application. That and they way the application has been handled by the advisor is the reason I'm complaining.
