really desperate plea for help !!!!

please can anyone help me or give advice on this
i sold a car on the 10/3/2015 did everything as i should and posted v5 off to swansea the next morning on my way to work all sorted or so i thought!!
fast forward to 10/2/2016 and i have sold my house i have then applied for a mortgage on my new property only to be refused because there is a ccj on my credit file.i was completely unaware of this.after getting the details from my credit file it was brought about by parking eye date of offence is 11/3/2015 the day after i sold the car and ticket issued on 19/3/2015.
so i knew i was not the keeper of the car on the date of the offence i was at work !! after contacting the dvla they have me as no longer the registered keeper from the 17/3/2015 (when they got the v5)
the offence occured when the v5 was in the post to the dvla i have rang parking eye and they basically did not want to know.
also i have reicived nothing from either the court or parking eye on this as they have my old address where i have not lived for 5 years
i now have my life on hold nowhere to live with two young kids as i cannot get a mortgage for my new property due to a £170 parking fine that was nothing to do with me for a car i had sold i have done everything properly/legally and am at the end of my tether i really dont know what to do

The date of transfer will run from the date you wrote on the V5,not when the the dvla receives.

so, did you write the 10/3 or the 17th when you remembered to fill it out and send it

Sounds like you might need to back out of the sale until/unless this can be sorted out.

Also speak to a Mortgage Broker to see if an alternative lender is possible.

CCJs expire after 6 years. You can also have the CCJ flagged as "Satisfied" which may ease the credit issues associated with it.

From this it seems you did not as you did not change your address.

Are you able to request a copy of the document you sent to check what date you put down?

Parking Eye will have got your address from DVLA.

It seems as though you did not inform them of your change of address???

But you may be able to get this CCJ removed now (as you have received it as a result of you being unaware the claim had been taken out, and presumably all correspondence from the claimant and the court went to your old address)

Google "set aside ccj" to learn how to do this. (Costs £155 and involves a (private) court hearing)

If you are successful, then the CCJ will be removed and you will then be able to sort it out with the claimant.

i did change my address on my licence cjdavis as it is illegal to not have current address on your licence.and i would lose my job as i drive for bt as my home parking details would be incorrect on my vehicle tracker.
i cannot request a copy of the document due to data protection laws this is what dvla have told me.

Parking Eye will have got the name + address of the Keeper of the car.

Nothing to do with your driving licence!

The driving licence and the vehicle registration certificate are both separate, so it doesn't look like you changed the address for the vehicle only the driving licence.

If they cannot give you a copy of the document, are you able to ask and they answer if you completed the date of sale/transfer and what you put?

The address on the licence is irrelevant to this issue.

You're also supposed to update the address for the car. That would have been the one DVLA gave to parking eye, and where the court papers would have gone.

Whats happened i'm guessing is in 2011 when you moved house, you didn't change the V5 for the car to your new address, you then sold you car in 2015, the day after the new owner parked illegally and got a ticket, parking eye sent a bill to the registered keeper from the dvla (you) and were given your old address, they obviously had no replies as you don't live there, it sounds like they then took you to court (for you to have a ccj) which you lost as you didn't give any defence (as you knew nothing about it_ and now have a ccj against you.

How you go about resolving this now i'm not sure, but its probably worth speaking to a solicitor/

They should be able to give information that relates to you. Would a freedom of information request be possible?.
