two way accident.

to start ... Hello

i have a small question regarding car damage. my car was damaged both front and rear by another. this all happened while my car was parked at the side of the road and the lady moved forward. lifted my car by the rear and rotated it from facing south/north to facing east/west while sandwiching it between another vehicle.
the rear has scratches and damage and the exhaust is certainly damaged (you can see where the my car exhausts on her nissans bumper (the circle near the reg plate where it dug in)
the front of the vehicle was pushed back a small amount and damaged during the lift and rotate.

anyway i was told from my insurers as its not my fault and im not liable im not paying my excess as it was stationary and not being used at that point ( and she hit a parked vehicle)
now im being told they deny liability for the front as it was only a bump.
whats the options available for myself on this as i dont feel this is fair at all.

also .. the other car the one that was in front only has a small amount of damage . a crack on the grill and the bumper. but mine was pushed back a touch and the lights damaged with the radiator due to the lift and push and drop.

    A car was lifted up and spun around and only had damage to the plastic part attached to the car with clips?

    Which car has these bumpers of such immense strength?

  • Are you sure the car only suffered that kind of damage i would expect a few parts to be missing based on your description of accident

    sorry my car was a peugeot 206 2006 .. the car that hit me was a nissan qashqah 2010 and my car was sandwiched on the front by the citroen cd something (bubble looking thing) 2015.

    no sorry i didnt upload a picture but i did see the event as it was right outside my livingroom window as did my partner and two children.

    were unsure of the other damage to the vehicle as he left the scene within 10 minutes but he did file a police report. ( my bumper was at an angle and lifted and his is not a fibreglass the small scratch shows metal under the paint (or atleast a metallic) sorry should have mentioned the scratch also

    my car was bumped forward about 4 foot while lifted - and then rotated as she was turning to pull out of the parking space.. also have a mechanics report on the vehicle from beginning of december as the mot was done at that time.

    If the damage to the front was caused by her pushing you into the other car, then you need to make this plain to her insurer. Or it might just be easier to claim straight off yours - if there's any damage to the car in front, then they need to claim off your insurer anyway, who will then pass that claim through to the insurance of the woman that hit you.

    I'm sure she does deny responsibility, but that's for the insurers to settle between them, not for her to say.

    but even she seen the damage to my vehicle.

    hence im getting a long delay on what was a simple claim and easy to fix. sadly i lost my peugout from this as its deemed a cat c loss because of the damages and repairs

    Just because it's CatC doesn't mean you've "lost" it. You can retain it, with your insurer deducting the salvage value from the payout, then you get it fixed more cheaply yourself.

    But, if it is a write-off, then you're being paid the value of the vehicle anyway, so whether your front bumper was damaged or not is irrelevant to your own claim.

    If the driver in front is claiming off your insurer, then I cannot see how THEY would claim it's not related, so they'll just add it to the claim being passed to her insurer. I find it hard to see how they'll refuse to pay it, either. So long as they pay, it's still a not-at-fault as far as you're concerned.

    but thanks .. just a bit livid as im losing my excess out because of this but was told i wasnt at first as i wasnt liable for this.now because she denies the damage on front or well her insurers do.

    just mega annoyed as the car was under 50k mileage.

    If her insurance pay, then your excess and NCB are untouched.

    I'm really struggling to visualise this...


    A woman in a Qashqai was parked behind your Peugeot? In pulling out of the parking space she caught your back bumper and lifted/spun your car through 90 degrees and pushed it into the Citroen in front? You watched this from your front window and didn't run out - shouting? She claims she didn't cause the front-end damage? Did you take photos of the resulting positions? Did the Citroen owner also come out to see? Did the Qashqai driver speed off or what? Who reported what to the police and have your insurers got a copy of that report?
    I need to think of something new here...
