Currently they don't have to go to court.
They hold a legally enforceable CCJ against you.
As it stands if you don't pay up in full they can take enforcement action against you which you will have to pay for (on top of what you already have been ordered to pay them)
They hold all the aces and have no possible incentive to agree to any negotiation!
They wouldn't advise Court that the CCJ was "settled" unless it was settled in full!
You need to concentrate on an outline defence that you will use to show at your set aside hearing that you do have a defence (that deserves to be heard).
At the set aside stage all this needs to be is an outline of the defence you intend to elaborate on as you believe you don't owe the money.
You would get help on that here.
But grasp the situation you are in.
2 options only! (Pay in full or apply for the set aside - at this stage telephone negotiation won't help you at all to get this blight removed from your record - can't keep repeating it!)0 -
OK, point taken, but will I even get a set aside based on the points I listed?
Otherwise it means paying £150 as well as the fines.0 -
Thinking about phoning vcs today to try and negotiate and settle out of court, just want this sorry mess over with

You have grounds for a set aside, you weren't even in the Country when the papers arrived and have grounds for appealing all PCNs, ALL of which are separate alleged contracts (denied) and none of which have had any evidence produced and none of which can create 'keeper liability'.PRIVATE 'PCN'? It's just such an uncertain situation as to what the outcome would be...
Even if the set aside was successful, VCS could reissue the claim and it could end up going to court and I could loose.0 -
IF, COULD, COULD
Lots of certainty there.
You could get run over by a bus tomorrow. You could win the lottery tomorrow.
Concentrate on what you CAN do for now, not on what COULD happen.0 -
loren , your cup seems to be always half empty !!!
FILL IT UP , GET A GRIP and GET ON WITH IT !
good job you werent at NASA managing the apollo moonshot program
the rocket could blow up on the launch pad
the carbon dioxide scrubbers could fail (Houston, we have a problem)
the moonlander could run out of gas before touchdown0 -

'were loose'
(only ManxRed will get that!)
:rotfl:
How are you 'liable' as registered keeper then?
They do not know who was driving on each occasion and they don't use the right wording in NTKs which are only capable of holding the driver liable. I could have been driving your van, I have comprehensive insurance which allows me to drive any vehicle with consent of the owner.
VCS have lumped 8 PCNs from different dates together and would need to show comprehensive evidence for each and every one x 8. And that's without even starting to look at the signage (in Excel's name or VCS' name?!) and then there's the landowner contract. Look what can happen:
