    The failure in signage is in my WS, but the Abuse of Process and De Minimis are my main points.

    As it is, BW Legal haven’t sent me their evidence pack yet so I need to check with the court to see if they have it.

    It's not just abuse of process which is covered by POFA2012, it's also The Consumer Rights Act 2015

Check with the court, buteither way you need to write to the court to sttae they have fialed to serve on your their bundle of documents, as required by order... of... date made nby judge.... and you ask that the court allows no relief from sanction for a professionally represented firm/.

    Did you see Premier Park had a case summarily struck out by Warwick court last week, for the abuse of process of adding £60? Search the forum for Warwick Judge Joseph and read the post.

    However, the abuse of the court process, of adding sixty quid, SHOULD NEVER be someone's main point in their WS!

    IT IS NOT A DEFENCE TO THE PARKING CHARGE NOTICE ITSELF.

    Ok, I can see I have muddied the waters, by trying to brief with my updates. De Minis is my main point; I also Signage, lack of landowner authority and a couple of smaller bits. I have included Abuse of Process in a supplementary WS.

    I have been hampered with signage as the car park is now closed and most of the signs and the machines have been removed.

    I will be contacting the court regarding the lack of anything from BE Legal when I get back in the country tomorrow as the court won’t accept calls from international number.

    I haven’t seen the Warwick case yet but will have a look.
  • Now that I am back in the UK, and not trying to work over a satellite phone internet connection, I was going to post a more in-depth update to clear up the mess I have created in the past couple of weeks.

    However, in my severely jet-lagged state I started opening all my mail, to see if anything important had turned up, and found a nice little letter from BW Legal. Said letter included a Notice of DIscontinuance. :T:T:T

    Thanks to all of you that helped me during this long process :beer::beer::beer:

    I am now going to get some sleep!
