BT Termination fees while in 14 day period

Hi everyone,

We had been on BT infinity for over 2 years when we rang up to cancel. While on the phone we mentioned our low income and they recommended BT Basic with broadband and switched us over to that as according to them we use within 10GB each month which I knew we clearly didn't but they were sure that we did and said if we weren't happy it was a 30 day rolling contract anyway. After changing over within 3 days we hit the limit and decided that we would just cancel BT all together and so signed up for a sky offer (we haven't even received the form needed to send back to BT yet). BT has now sent as an email saying we must pay early termination fees of nearly £300 for a contract that started a couple of days ago.

When we rang BT they told us that it wasn't a 30 day contract first of all and that it was 12 months and that we couldn't leave without penalty due to this. Surely even if it is 12 months which they most definitely didn't say it was we are in the 14 day period where we can cancel.

We've now had to cancel the sky order and asked to be put back on our old out of contract package which they now say takes between 2-3 weeks. We haven't got any confirmation they are doing this.

When speaking to sky they said that a request made by them to move over to sky counts as us having given notice but BT were still adamant that if we left for sky we would have to pay a £300 termination fee.

    As you were already a BT customer I doubt if you get a 'cooling off' period, and starting a new contract is going to have a minimum 12 month term, so ETC's would apply, however if you were sold a product that they new to be unsuitable ( if they said 10Gb was less that you use in a typical month, but that was never true) get then to listen to the call and they may waive the ETC's

    As iniltous says, you'll have to hope they find the call recording (or just agree with your points) and don't pull a fast one.

    The fact that you were told it was a 30 day contract would also be grounds for cancellation without charge, as you were missold. You could argue that point also but it may not work without the evidence.
