im not expecting a new car at all but two of the faults render it undrivable the water leak and the oil leak
they were both present at purchase so i rejected it.
the climate and locking fall into the not as described area of the law misdescribed
the supercharger is worn out I've heard the bearings myself via a stethoscope
Did you spot the oil and water leak when you initially went to view the car prior to buying it? If not, why not?0 -
wasn't sure to be honest, i tried to phone the dealer to ask him again for a refund today and he said i cant talk to me my solicitor told me not to....id have thought a good solicitor would tell him to resolve this issue out of court if possible?
i can stop the legal action at any time if he decides to do the right thing..
On the contrary, a good solicitor will tell him to only communicate via a solicitor in writing once litigation has started.
If you want it sorted so you can cancel the action (which is backwards - did you send a Letter Before Action?), then you need to do it in writing, and address it to his solicitor.0 -
so as the legal process moved along he agreed to send a different car for me to consider as replacement.
i wrote back and rejected that as well as it was rough, also he did say he would refund me but only after re selling the mini.....i then asked what particular reason for that? anyway next email is he finally refunded me today after two months of dodging around the houses.
he did just sell a couple of 10 grand ish minis though....0 -
the email from the dealer said no hes not part of an ADR scheme and he was not interested in one.
his warranty was an in house one, fairly stupid given hes a one man band dealer. whats wrong with a corporate warranty company? unless he cant afford one.
A lot of dealers struggle to get the warranty companies to pay out so prefer to carry the risk themselves.0
