PCN Tesco Gatwick

Hello,

I've received a PCN from Horizon Parking becouse the company car that I am using was parked at the parking at Tesco Gtawick while I was getting my coffee.
The reason for the PCN is: No Taxis Waiting or Parking
The company car is registered as Private Hire Vehicle but I wasnt working at that time when they took the pictures of the car. The two pictures that they have attached to the letter are just few seconds apart and on them is clear to been seen that the car is working with tail and head lights on.

My question is what to do next? I have a Tesco club card and I am a regular customer at that Tesco and I tried to speak with the manager on duty, but the only response that I get was to appeal to Horizon Parking!

    Read the Sticky thread for NEWBIES and then appeal using the BPA template in blue. Copy and paste verbatim. Nothing added and nothing taken away.


    In addition, complain to the CEO of Tesco that you will become an ex customer if this ticket is not cancelled, and you will ensure that your friends and family never ever enter a Tesco gain. Neither will you ever take any customers you might have when you are working to a Tesco either. Point out also that the manager you spoke to was distinctly unhelpful as well.

    A couple of things, first of all is there any risk that your company may pay the ticket?
    Secondly you should do a bit of reasearch and then go to the store again , this should eb easy as you/if you are a regular and tell them that they must cancel the ticket issued by their agents, Horizon pakring "Hello mr ( or mrs) manager person, I received a parking ticket from your agents Horrizon parking for _________ as a result of __________ and im asking you to cancel the charges as they are unjust because of _______ heres a copy of the correspondence i have had from your agents.

    manager " im sorry but you need to get in touch with Horizon parking as they control our car park"

    You " But you havet his company on your car park, and as they are your agents you are liable for their actions, just as you would be responsible for the actions of your agency staff and contractors "


    you need to be firm, polite and stand your ground, a lot of people think these are genuine fines and pay up, and this includes store staff as well

    This has come up before as taxis use the Tesco car park to wait.

    The manager of the small Tesco's has no power so you need to contact

    As you have a club card, you can tell Jason.

    But .... tell your taxi driver friends that this Tesco car park is not for taxis, Horizon will issue more tickets, no doubt they are watching

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that the signs were not seen/are ambiguous and the terms unclear to drivers before they park. Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as I believe the driver may well be eligible for cancellation.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    That's the one, either gets you a POPLA code or cancellation. Make sure the postal address is stated even though it's an email because sometimes PPCs pretend an appeal isn't good enough without all details being stated.

    If they ask who was driving or for proof of spending, DO NOT tell them who was driving! Don't imply it either.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    I would amend that appeal by adding that the vehicle was being used by the driver in a personal capacity when off duty and on subsequent inspection it is clear that the intent of the signs is to be applied to taxis that are being used as such, not when being used as the transport for drivers acting in a personal shopping capacity.

    Yes, something along the lines that the driver is a regular shopper at this Tesco and was making a purchase before starting work. The driver was "off duty" and had no passengers so the notice to taxi drivers is not relevant.

    I've sent the appeal over the email but still no answer from horizon parking.

    Instead I have received a new letter from them that my PCN is over due and if I don't pay within 28 days the case will be passed to their debt recovery agent.
    I also tried to speak again with the same manager at tecsko gatwick to cancel the PCN but he told me to come back in a week to discuss the PCN (to busy).

    I will update again...

    You are still trying to get it resolved with a 2 bit manager who is now fobbing you off ??

    You now have the opportunity to complain to Jason Walczuk not only about Horizon but, is the manager seriously saying, I don't want your money today, come back next week.

    The manager either needs to be retrained or given his P45

    Is this a black cab or a private car? If the latter you can surely argue that it was not being used for public or private hire.
    You never know how far you can go until you go too far.
