    it might be - legally - however in London in my renting experience it was never presented as an option! Usually it's new AST or S21... I will speak with the EA and LL to get the S21 issued I supposed.

    what options do I have? my current AST is expiring first week of March and I am in the process of buying a property (awaiting mortgage decision).

    I don't want to sign another AST locking myself with a 12 months (6 months break clause).
    The agent is chasing me to sign a new AST!

    any suggestions?

    If the let is managed through an agent, the first thing to do would be to bypass them and explain your situation to your landlord.

    If you have been a decent tenant, and Landlord is a decent person, landlord may be receptive to your request to let your current tenancy roll over into a periodic one. Assure landlord that you will keep him/her in the loop as to the status of your purchase, and will give as much notice beyond the one-month minimum as possible.

    Big whoop-de-doo if you're issued a Section 21 it doesn't mean that your landlord will use it to go to court to get an eviction notice. Section 21s seem to be used as an aggressive tactic to get you to sign a new fixed term but will they ever be acted upon?

    Take danselnoir's advice and talk to the organ grinder.

    Contact the LL and explain that you will be buying a house soon and will therefore be moving in the next few months and won't be signing a new contract, but let the current tenancy go periodic and give them notice as soon as you exchange contracts on the new house and keep them updated on the progress. If they have any sense, they will leave you to it. If they do go the legal route then it will take time to get the case heard and then get bailiffs. It would seems ridiculous to do this to a paying tenant who is keeping you updated on when they are going to leave.

    You cannot possibly believe that London is somehow different to the rest of the country/countries?

    Like everywhere else, there ill be LLs and agents in London who are flexible, others who try to impose a new fixed term but give up if the tenant declines to sign, and some who issue a S21.

    Just like elsewhere, evicting a paying tenant is

    * bad news and un-economic for a landlord

    * but may be to an agent's advantage as further fees can be charged for finding a replacement tenant

    This applies equally in London, Cardiff, Newcastle and Little Widdlington.

    My apologies, I don't believe London is different, as I said, in my experience (and what I heard from others) usually it's either a new AST or S21. LL and EA are not overly keen in periodic agreements. Sure they exists, some may even have them but I never came across them.

    Last time I suggested that to my LL, I got a S21 issued before I ended the call!
    With the new suggested AST, my rent is going up 5% for no reasons and the LL won't budge.... c'est London!

    Have you rented in London? Usually two months before the AST is due to expire you get a new AST and a Section 21 mailed, you can then pick what you might prefer!

  • ta-da - I asked the LL yesterday, I have already a S21 in the mail today!

    Periodic leases maybe a possibility...
