New AST or?

My current AST is fixed till beginning of March, the LL EA got in touch to renew the lease (with an increase of course) and that's fine... I am still waiting for the new AST for me to sign.

If I get no new AST by the last day, I suppose my current AST become a rolling periodic contract, if I don't sign the new AST, technically, I can't be evicted on the last day of my existing AST but I still be given 2 months notice right?
(there's no arrears, etc - I am talking about technicality of dates)

No Section 21 or whatever was served to date... I am just curious!

So far, my experience in London is that the option to get into rolling periodic contract is a myth, most LL or EA force you to sign a new AST every time.

    Most agents want a new AST so they can charge fees to both tenant & landlord: Many landlords prefer not to have a new AST as periodic gives them more flexibility (my view).
  • so if say (hypothetically) at the end of the month (days before my current AST expires) I get to sign this new AST and say no. All the LL can do is serve then a Section 21 that will start from the serving date?

    At most they may lead you to believe that going periodic isn't an option.

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?

    Have you rented in London? Usually two months before the AST is due to expire you get a new AST and a Section 21 mailed, you can then pick what you might prefer!

  • what options do I have? my current AST is expiring first week of March and I am in the process of buying a property (awaiting mortgage decision).

    I don't want to sign another AST locking myself with a 12 months (6 months break clause).
    The agent is chasing me to sign a new AST!

    any suggestions?

    If periodic is no option (in London usually isn't) I guess beloved Section 21 here we come! At least it'll buy 2 months

    It is an option, it is statutory law if not contractual law. Would any right-minded landlord go to court to evict a paying tenant over a periodic tenancy?
