    Is the PCN number on the NTK the same one as on the windscreen PCN? Maybe there are two?

    thank you for your reply again, I will go to castlepoint management tomorrow to see what help they can offer and also hopefully Next management can help .
    I know the fact is that the appeal seems to be nothing a wasted effort as always with this parking companies. They are fraudsters and i am caught with the nasty one.

    Interesting they got the date wrong then unless the February date is just the date of the NTK? You typed 2.15 - did you mean 2.16?

  • @coupon-mad - there is a difference of 2 days between PCN and NTK. NTK has 2 days early date of actual PCN.

    Possibly one worthy of an IAS appeal then. Are you the registered keeper yet were not the driver? Can you prove you weren't driving (the IAS won't believe you unless you can prove it wasn't you driving)! If you can, as part of your evidence, then you could use the fact the NTK doesn't repeat the information in the PCN, a fatal breach of schedule 4.

    Maybe not 'fatal' in the warped eyes of the IAS but could be worth arguing if you can evidence where you were/that it can't have been you driving.

    you could also ask the IAS to make sure that their ADR service is fully compliant with the ADR regulations, there are a few pointers here http://parking-prankster.blogspot.co.uk/2015/08/independent-parking-committee-fail-to.html

  • Hi experts, shall i initiate any communication with Devere about this? Perhaps i know the fact that all they want is my hard earned money but still they have many lapses like
    1. No clear sign of PCN antwhere in the parking, its more than 600 cars parking and i have not seen any sign.
    2. They have not provided any photo evidence and demanding 10£ for it.
    3. The letter sent was of 2 days earlier on which i was actually working in my office.

    Please advise if i shoul send any appeal or answering letter to them? If yes, can you advise with format or a small write up?

    In order to get to thee IAS you ned to be rejected by the PPC, however first i strongly suggest that you read up on and research the IAS via the parking prankster site/blog and on here, so that you can go in knowing with what you are dealing with.

    Next when your appeal gets rejected by devere you fire off a complaint to castlepoint and then get to work on the IAS appeal, you complain to castlepoint that the charge is unjust etc etc, and you demand that the IAS fully comply with the ADR regulations.
    when this gets rejected ( odds on it will be ) you then make a further complaint, put the full appeal/rejection train on here so that others can eye it over and spot the flaws.
    You then complian to all,
    To castlepoint telling them that their agents have failed to comply with the ADR regulations ( and state why and how) and then demand that castlepoint either cancel the charge or re-imburse you for your wasted time ( at £19 per hour from here on for every letter demanding moneys/payment)
    also post your complaint to their facebook page ( if this is it) https://www.facebook.com/CastlepointShoppingPark/

    complain to the Chartered Trading standards institute that the IAS has failed to meet the requirements for an ADR entitity

    and complain again to castlepoint

  • @half_way i will speak to castlepoint office today to get their opinion on this and then follow the rout you suggested.
