Devere Parking Services - Castlepoint Bournemouth

Hi Experts,

I have searched this forum for almost all possible threads including Newbies, which suggests to open up a new thread if PCN is from Devere Parking Services.

If no time to 'dig out flaws' in paperwork, just use our appeal example unless your PCN was from these where you will certainly need to start a new thread:
[/FONT]
'Devere' (Bournemouth usually, e.g. at Castlepoint)
'District Enforcement'
(Staffordshire University etc.)
'Secure -a-Space'
'Napier'
'Combined Parking Solutions'

hence opening a new thread.

I live in bournemouth from many years and never ever had any issue in shopping at castlepoint however - my wife visited there for shopping ofcourse and upon return, she found a PCN from Devere Parking services.
The reason for issue was " Did not park in a designated parking bay"

However, at castle point I have never seen any signage of parking notice from this company, but by reading many forums- it looks like this company has very bad practice of threatening people and using malpracticie to get money out of.

Initially I simply ignored the notice but today I have received their first NTK via post.
However, there are 2 issues here
1. They issued notice on X Date 2015 (which is written on PCN as well) but they have mentioned the date of X-2 2015 in the NTK.
2. In PCN they have mentioned the time of XX:YY whereas in the NTK they have mentioned the time XX:YY+10.

Also, in the PCN they have mentioned if I need any photographic evidence - then I will have to pay 10£ regardless of medium they provide it to me (is this legal? they want money from me and dont want to even provide evidences for it?)

Any expert advise is appreciated

Thanks
V

First thing, do you have a receipt for shopping, if so contact the CEO telling him why you will never shop in his store again ... the reason being is Devere Parking services

    Who is the retailer ?

Asking £10 for photos, so they penalise you with a further scam to provide their evidence. They cannot be taken seriously with no evidence, they have to prove to you that the PCN is correct.

be very cautious with this scumbag , your problem is that you live in there home town , don't suppose you have a relative that lives close to Gretna green?

any appeal via them or even thru the IPC is useless , collect your ammo and await the scummer starting proceedings , they will have to produce any photographic evidence to you FREE before court .

For those not familiar, Castlepoint is a large shopping developement on the east side of Bournemouth, with several major retailers (Sainsburys, Asda, M7S, B&Q, Next, etc etc etc...).

Devere are a particularly nasty bunch. It has also been alleged by some that the local county court always find in their favour, though I can't think why....

The signage is poor- as you drive into Castlepoint there is a small sign on the left on one of the entrances but you'd have no chance of reading it. The only other signage is by the disabled bays and seemingly applies to those.

Your best bet at the moment is to complain strongly to the store manager (not a customer services minion) in the stores where you spent money, and also complain to the office on the lower deck not far from M&S, reminding them that they are the Principal and can intervene in this (don't get fobbed off by them saying that they can do nothing.)

Devere will turn down any appeal and so will Skippy at the IAS in all probability, they almost always say no... you need to get this cancelled by the stores/landowner to avoid court imho.

Would this be a breach of the IPC code of conduct?

not that they would care, of course.....
  • Retailer is NEXT. I will go there tomorrow to speak to their store manager and also Castle Point office as advised by catfunt, however - my worry is , do I need to send them any appeal in writing or appeal to IPC as most of the forum threads have suggested that IPC is very biased body and they refuse your appeal all the times with arrogent attitude.

    Thanks

  • Dear Quentin,

Can you help what should be my next couse of action? I can go to store manager and castlepoint mangement office but except that do you think i shoud initiate any communication with Devere?
They seems to be cowboys but reading multiple forums, it looks like they have very good record of recovery at least in bournemouth and around even in local court. However, my only concern here is - why would they charge me for looking at evidence and even with extreme poor signage across the car park?

    thanks

Of course, try the store manager, if that fails, straight to the CEO

Remember, you don't have to shop at Next but .... they need you and your friends

IPC /IAS IS SIMPLY A KANGEROO COURT
They are used mainly by scammers so they can win.

Yes, go in there (Castlepoint office) and ask for the Manager,
I wouldnt bother with the PR smiley person on the front desk who would likely fob you off.

If you have a Twitter account, might also be worth complaining publicly on there to @CastlepointShop and include @Bournemouthecho too.

You should be putting everything into getting this cancelled by the landowner via the management agent/retailer.

You can appeal as set out in the newbies thread, though you seem to realise that it's going to be rejected, and a court claim is likely
