Taking my ex employer to a tribunal

All I can really say is that these people don't spend nearly as much time thinking about you as you think they do.0

About to give up here too. Me explain something. If this was normal crime committed let's say I was to scratch a car, and only one person said they saw me do it. The police will not be able to prosecute for it as there is no independent witness! The same has happened here with me in work. Two separate allegations but no separate witnessess to their claim, They were not backing each other up. You keep saying but why The first person say you were renting a raving to another member of staff. But then this is the exact same person I said I was waving my arm around in the aggressive way whilst holding a phone to my ear in my good hand. The second person with their totally separate allegation would say that to be nasty about managers, that's how people are. Oh it might not even get to a tribunal anyway. They've got until Monday to respond within an ETA3, otherwise I win!0

The police will not be able to prosecute for it as there is no independent witness! - YES THEY WOULD. Normally only the victim is able to give evidence in crimes such as mugging (or rape, or domestic violence or...) and that is plenty. And that is beyond reasonable doubt. Employment law is civil law, which is on the balance of probabilities. The same has happened here with me in work. Two separate allegations but no separate witnessess to their claim - why do you think there needs to be separate witnesses?? , They were not backing each other up. You keep saying but why The first person say you were renting a raving to another member of staff. But then this is the exact same person I said I was waving my arm around in the aggressive way - and that is enough. That person has made a complaint (just like you made a complaint!) whilst holding a phone to my ear in my good hand. The second person with their totally separate allegation would say that to be nasty about managers, that's how people are. Oh it might not even get to a tribunal anyway. They've got until Monday to respond within an ETA3, otherwise I win!
You're living in a fantasy world if you think any of what you wrote has any legal standing.
You need to hope they don't reply, because you have zero chance at a tribunal at the moment. (me, and untrained person, with limited legal knowledge can pull your argument apart - imagine what a qualified and paid for solicitor will do)0 -

You really have no idea. Do you want to know how often tribunals waive these deadlines for late submissions? Almost every time. Automatically. There will always be a good reason.
And you are totally not getting it - just because you don't get the advice you want doesn't mean it's the advice that is wrong. So let me explain something. As a matter of fact several years ago someone crashed into my car whilst parked. One person saw this - and actually both the police and the insurers accepted their witness statement and they were forced to deal with their action.
And this is not evidence that needs to be to a criminal standard - as you have been repeatedly told.
I have been in hundreds of employment tribunals. You really have no idea what is going on or what is going to happen. You cannot act at them as you have here or you will be handing the case to the employer on a plate. And with that, since you keep repeating irrelevant information that you have been told has nothing at all to do with your claim, and can't answer the questions asked which are relevant... well, I'm going to leave you to it.0 -
my advice to the OP would be to say NOTHING at the tribunal
because she clearly has NO idea what she is in for!
let the FACTS speak for themselves
did they follow their own disciplinary process or not ?0 -
Not being nasty or anything, but you need to go back and read again. They identified that I needed support back in May last year. How will I lose against people who say I was waving my arm around in an aggressive way whilst holding a phone to my ear when I only have the use of one arm and hand. I have medical evidence and brain scans images to back this up! I only made this topic to ask why would a company take so long to respond to a tribunal claim when it puts them at risk of not being able to defend themselves in court! If they had nothing to hide they would have responded by now! How do I know they haven't responded? It's because any response from them gets forwarded to me!
my husband took his former employer to an Employment Tribunal they asked for extensions on the date FIVE times and were granted the extension on every occasion.
you have NO idea what they are doing to formulate a defence and actually, if they come here and read this thread - they wouldn't even bother- they would just let you rant and rave in court and any sane tribunal would find against you.0 -
TBH OP your comments are pretty incoherent and make no sense - it appears they had good grounds to sack you based on your behaviour at work and you're now playing the disability card. Sorry!0

That is exactly what I am saying. The person that has said I called a manager a !!!!! and a lesbian had her son sacked by this manager. She also knew that this manager sexually harassed me. She even told me that it was sexual harassment what this manager was doing. So she would say something nasty about this manager and use it on me. There was no witness on her part to back this accusation up. As I have said I am bisexual, lesbianism is part of bisexuality. If I had been asked to expand on this accusation in my appeal hearing, I would have told them, this. In fact I started to tell the manager in the appeal hearing why this person would say this, they didn't want to listen.
This other person, Who said I was waving my arm around in an aggressive manner when I had the phone to my ear in my only good hand. This is a visually a blatantly obvious lie of which the manager in the investigation accepted despite knowing I only have the use of one arm. Also saying that I was ranting and raving to a member of canteen staff, then not taking a statement to back this accusation up, neither was there a witness on her part to back up what she said. This is all relevant this is what they based my dismissal on. And from the statements it was he says she says. They've all got together to make up their story's.
This person that said I called this manager a !!!!! and and lesbian, has told someone Who 4 months earlier I mentioned that I had a hospital appointment two days before Christmas because of the epilepsy investigations, so that it was sorted on the Rosta, then they've gone and said I didn't plan on working the Christmas period. They use that in the investigation even though it wasn't true and it's four months to late to report it!
Did you even read what Tripled wrote? You have been given excellent and spot-on advice by people trying to help you - and you respond to this with more he-said-she-said stuff.
I am sorry for what has happened; but I cannot see this going positively for you if you refuse to take sensible advice from well-meaning people.0 -

Them not replying means that I win. They won't be able to defend themselves!0 -

No it doesn't.... As you've been told it can be extended.
You have no idea.
I'm sorry but the information has been so clear in this thread, you don't get it at all. You will lose at tribunal if you don't work on your case.0
