Delayed BA/AA flight

Last year our flight from Chicago to London Heathrow arrived over three hours late. The flight was with American Airlines arranged through British Airways. I still have the boarding pass and other relevant information. I have been in touch with BA and AA to do no more than register my displeasure but both airlines have been very offhand, been very tardy in replying and passed the buck. In view of their attitude I am now considering seeking compensation under EU rule 261/2004. However from initial investigation it looks as though I cannot claim under this rule. Am I right? Any advice will be much appreciated.

    What aspect do you believe makes a claim inadmissible?

    Have a read of Vauban's Guide referred to all over this forum. That is as good advice as you will get and should give you ideas for the way forward.

    AA have no liability under EU261 for flights delayed in the US returning home to the UK

    Whoops! I'm very rusty obviously. Just getting back into the whole thing to help a relative.

    Anyway, fortunately, Vauban's Guide gives the right answer.

    It's irrelevant who you booked with, what is important is the airline operating the flight - in this case AA.
    The flight would have been a codeshare and you got a BA flight code because that is who you booked with.

    Sorry if that's not the answer you're hoping for but it's really quite simple.

    If the plane you travelled on was operated by American Airlines, then your flight was with a non EU carrier and they have no liability on flights not departing from within the EU.

    In the reverse, if someone books with AA with an AA flight number but operated by BA, the claim would be against BA and would qualify
  • Indeed, Yeah code share is a nightmare to unravel

    It's all about who actually operates the flight and not necessarily who you booked with.....

    Delays happen with airlines...until EU261 came in everybody "got away with it" now all flights departing from the EU and EU airlines departing from anywhere to the EU have to comply
    Have you checked your travel insurance to see if they cover anything?...although often they may have something like £20 for each 12 hour delay
    Did you suffer any financial loss or just an inconvenience of a 3 hour delay?
