Cancel 3 contract

Hi, I took out a contract with 3 in December 2015. I got home and I couldn't get any network coverage so I wrote to them in December 2015 recorded delivery twice and they say I owe £95 but I canceled within 30 days and never even made a call or text!

Do I need to pay?

    what have you done with the handset?
    Was network coverage at home guaranteed?

    Never making a call or text is irrelevant. If you cancelled then you would still owe for the airtime for that month. It's not clear what you have been charged for, or whether you can legitimately cancel within 30 days-there is no statutory right to do so. Did you buy instore or online/by phone?
    No provider guarantees 100% coverage, so did you not check using the online postcode checkers?
    No free lunch, and no free laptop ;)

    "got home" indicates in-store.
  • When you made the purchase they must have asked for your address, and they should have checked the signal quality. <cough> didn't the salesperson promise it would work ok?

    What right or term did you use to cancel as there is cancellation for instore purchases in their terms?

    If you purchased directly from a Three Store

    We’re sorry, but if you bought a Device or Accessory from a Three Store and you change your mind, you’ll be unable to return or exchange it.

    Or did Three do a goodwill cancellation for you? If so, you'll need to pay for the period it was live.

    Hmm, it seems you may have a stick to beat them with, especially if the actual signal is much worse than what they claim.

    Sim only is still a contract, could you answer the questions relating to cancellation?
    What was the monthly cost?
    What was the minimum term?
    What term did you rely on to cancel or was it a goodwill gesture to cancel by Three?
    Are you sure it is actually cancelled and that invoice isn't just for arrears?

  • 12 month contract at £10 pm. No signal so canceled straight away in writing as they advised. Luckily sent it recorded delivery, they said they never received my first letter (they did) 2 more recorded deliverys and an email they agreed to close account. We will see through. Thanks
