  • I would contact trading standards - I had Mint investigated for calling me when I told them not to with a letter much the same as the one above.

    They stopped after that, believe me.

    The 8% surcharge for calling you, that's very wrong.

    Consider posting this on the consumeractiongroup forums, there's a lot of knowledgeable people on there who really know their consumer law very well.

    Good luck with it Katie - I've used similar letters to the ones that Snaggles posted and they do work. I've also had telephone calls which have been upsetting as at the time, when you are speaking to them, it is quite scary. I've also been shouted at and threatened etc etc. It does shake you up but as everyone points out, they have to abide by rules and regs and this one certainly wasn't!! Why don't you also write to them stating that any further communication from them should be via letter only? I've done that with all my debtors and so now don't receive any calls at all, if they need to get in touch with me, they send me a letter. Good Luck :o

    The man was obviously trying to frighten you with the threat of court and did not like it when you said that would be fine. It sounds like he was just making standard threats in the hope that you would just pay up the whole debt. Please don't worry, the man sounds like an absolute idiot who has no actual idea of the way debt collecting works through the courts/ccjs/bailiffs etc. You got some excellent advice about what to do next above but the first thing you should do (as already mentioned) is contact your bank about the standing order. (((hugs))) to you.

    Katie - another thing you could do is to ask BT or whoever your phone is with to block incoming calls where the caller hides their identity (which these barstewards almost always do). This may cost a couple of pounds a month, but sounds as if it could be worth it. Try not to let it get to you - it's all bully and intimidation and mostly bluff. Best wishes.

    hes lying. The court will listen if you have been through the cab.

    It shouldn't get that far & even if it does the court will be on your side.

    Ask for all correspondence in writing & if they call again tell them to send a letter & then hang up.

    THANKYOU!! Thankyou all so much for listening and taking the time to reply! I think he called me at a bad time, my aunt is in hospital and today is my visiting day so i was emotional anyways, if it had been any other day i would of told him where to shove his 8% charge!

    Ive called the bank and although the standing order has come out every month without fail they say this month it was not scheduled to come out, ive not cancelled it or changed it and they confirmed there is nothing on their system to say that i had. They have no idea why it was not sceheduled to come out but have said they will look into it for me and have confirmed it is set up to come out next month. Ive sent a cheque for £5 for this months recorded delivery this afternoon.

    The more i think about it the less upset i am and more angry. Ive never been spoken to like that and the sheer ordasity (sp?) of the bloke to tell me that he can shout at me! He kept talking over me about the courts and i now know it was to intimidate and scare me but i just kept saying that it was fine i could prove all of this, he was saying i would have to prove petrol shopping bills etc but i keep all receipts anyway so i think i called his bluff there lol

    Ive also sent snaggles letter recorded delivery so will await their reply on that.

    Well done for sorting it out. Once the letter has been sent, if they call you again just say you've requested no telephone contact and they will be in trouble for contacting you and then ask for their name so you can report them. They usually hang up pretty quickly after that!

    I had someone at Mint absolutely terrified because I said 'You've messed up by calling me again - Trading Standards are investigating you for harassment and I need your details to pass on to them'. Never had another call after that.

    Northern Rock tried to tell me they were allowed to call up to 10 times per day, so I asked for that in writing so I could pass it on to the relevant authorities to check. Never received anything, what a surprise:rotfl:

    The thing is they think they can scare you, and also think you will believe what they say. Once you realise sometimes they don't tell the truth and can't be trusted, and the rights you have then you're sorted.

    Makes you wonder just who writes their scripts. :mad: :mad:

    Just ONE intimidatory call, like the one that Katie received, can be classed as harrassment.

    Anyone who has to resort to the tactics of that caller from DLC is pure 'lowlife' and deserves not only to be reported, but he and the company that he purports to represent should have their 'Debt Collection' licence rescinded permanently.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    What a horrid man, it might of been the guy who rang me this morning, he got very shirty when i wouldn't confirm my D.O.B or postcode. I have stopped discussing payments over the phone as i think compromises my identity and buts me at risk of ID fraud, I dont know who they are when they cold call they could be anyone.
    without me confirming who i was, he said i owed money to them and i HAD to confirm my details. My answer was thanks for calling and good morning, then i put the phone down. I have learnt to deal with these horrid people and try not to let them get to me. Don't let them win, He properly has little man syndrome !!!!!
  • Glad to hear you're feeling better katie_baby, sounds like he was just trying to bully you into increasing your payments.
    Could it have been that your standing order was set up to last for a set period rather than ongoing?...and perhaps last month was when it expired?
